Hello everyone, I am new.

I have dual citizenship, US/Canada. I am married to a Mexican citizen who has been living in the US since he was a child and he is undocumented. Getting a green card is very difficult so we are going to move to Canada. I mailed the sponsorship application two weeks ago, mid Feb 2012. It is not showing up when I check application status yet.

Here is the situation: We applied for AND received a permanent resident card for him in 2010 but we couldn't move before it expired because I was pregnant and a few other reasons. We have a lovely little girl, 15 months old. She got her Canadian citizenship already. So it was a bummer to let that visa go and then have to do the ENTIRE process AGAIN including pay for everything again.

Last time it was so easy. 4 months which was way faster than expected, no interview, smooth sailing. But we need to move in April as my parents are moving to Toronto and we can put our stuff on the moving truck which saves us thousands. I sent in a visitor's visa application for him on Feb 29 but I was reading on other message boards that they might not let him in to Canada because there is no proof he will go back to Mexico as he cannot return to the US since he doesn't have a visa. He has no job, address or any real ties in Mexico.

Should the baby and I move in April and he stay in the US and wait? Because we don't want him denied entry to Canada with a temporary resident visa and then stuck in Mexico with nothing and no one.

I would appreciate your advice. Thank you.

You and the baby can move up in April, leaving him in the USA. This will also make it easier for the visa officer to believe that you will be moving back to Canada, something which you would have to prove otherwise.
He is unlikely to get a TRV, since he has no ties to Mexico, but who knows.
You could also move most of your things up to Canada, then come back to the States and wait with him, with just a few necessary belongings.

Thank you for your help! Does it matter where my husband lands? The application was all set for us to go to BC but my dad got a job offer in Ontario just a few days ago, and my parents are moving to Ontario so we want to join them. Do I need to tell CIC about our location change? I don't want to make it complicated and delay the process. I think I am going to move our things and come back to the States and wait for him. We have some furniture that we are going to sell that we can use plus just keep the essentials.

Thank you!

The location change doesn't matter. If he is interviewed, they will most likely ask about where he will be living, and he can tell them about the change in plans, and why; he should have some proof of it as well.

You could also write a letter explaining the change in plans and send it to the visa office. I don't think it is necessary, though.

Thank you. So if we don't write a letter and he doesn't have an interview - it doesn't matter that he will land in ON even though our application said we would move to BC?

No. He can land in a different province than the one he originally said he would be going to. (Quebec's rules are different though.)

This eases my mind. Thank you!
