I need some information regarding sponsoring spouse. I was refugee and my case has been denied. I didn't apply for appeal or anything. After 8 months I got married to Canadian Citizen. Now he wants to sponsor me as a spouse.

My question is do I need to change my status before applying for sponsoring spouse or am I still eligible to be sponsored. I didn't receive any removal orders yet.

Somebody told me that I have to apply for change of status as I have to come on visitor status first and then my hubby can sponsor me but I read somewhere on CIC website that from MAY 17TH, 2013 . Canadian can sponsor illegal spouse no matter what status.

Kindly clear this thing to me

He can sponsor you, even if you do not have legal status. However, you should be more concerned about the fact that your application will be heavily scrutinized, because of your failed refugee claim, and that you guys got married only after 8 months knowing each other. It's not to be mean or anything, but I highly recommend you guys wait at least a year, and keep proofs of all your contacts until then, that will make your case stronger.

Thanks for your reply but we are married in Canada and our marriage certificate has date on it so no point to wait so long. Also I knew my hubby for 1 year but we decided to marry after 8 months of my denial decision.

We have prove like photos, videos, calls, text etc we went for honey moon with in Canada. dont you think it will be enough evidence.

My main concern is right now I am not legal so can they refuse on that basis only.

Plus someone said go on H&C first and then apply for sponsoring...

I dont wanna go here and there. I wanna go for straight Inland sponsoring.

You only get one chance (since you are applying inland) to be sponsored into Canada, wouldn't you rather give it time to make your application more convincing, rather than rush it and risk being rejected? If you apply inland, if they refuse you, you cannot appeal any more.

Applying to immigrate to Canada in so many ways, H&C, refugee, etc will make the visa officers think you're desperate to enter Canada, and this will hurt your sponsorship application. May I ask what country are you from?

Hi,I wouldn't wait if I were you either,by the time they finalize your application who knows how long it's going to be with the way everything has slowed down anyway!!!-If they did decide to issue a removal order to you,it'd be beneficial to have an application sent already!!!-In my case they gave me a chance to apply for sponsorship within Canada after my PRRA was rejected!-The officer couldn't understand why I did not send an application as soon as I got married(well,spilled h2o now).......

If you apply H&C they will ask you to apply for sponsorship anyway since you are already married and qualify under the said category!-so go ahead and send an inland sponsorship!!!-I didn't have legal status for more than ten years when i applied!!-Also if you have a work permit you'll still be able to renew it!!!

be honest and hope for the best. hope you are not marrying solely for PR purposes. too many good hearted guys get used and discarded. happened to a friend of mine.

I also wanna make sure that I can apply directly for inland sponsorship as I am out of status for last 8 months and not working at all.

Also when I apply for inland sponsorship should I apply for open work permit same time or wait for sponsorshop.

You can apply regardless of your status, so since you are married its best to just apply now and not wait. At the same time apply for any work permit you qualify for and try to keep your status valid if you can (not sure if that is possible not that it has expired, but if there is anyway to get valid status then for sure do it). But even if you can't it wont affect the spouse sponsorship application.

Hi,am still waiting on my application,so far no interview,knock on wood!-Am still able to work,just renewed my open workout!-Am thinking you should still be able to get a work permit since you were a refugee and haven't been given a removal order yet!!!!
