wow.. so quiet in this discussion board! We are still waiting for the answer from VO. I am not sure if she received the fax and emails.

It take some patience! nothing changed on Ecas(cic.gc.ca), it said his interview on Oct 18/2012 and medical record been received, that's it.

*censored word* this.. I want to die.
I'm very sorry, Dani. That is heartbreaking! How a relationship cannot be genuine when you moved to a developing country to live with your husband for one year, I don't know.

This is a very difficult time, but you need to pull yourself together for your daughter and your husband and you need to decide what you're going to do. Will you appeal the decision? Will you reapply? The little I know about the Rabat visa office, I think you might be better off appealing the decision otherwise you risk getting the same visa office making a decision on your file and having the same negative thoughts about it.

Again, I'm very sorry for what has happened. It's so so beyond wrong to keep families apart like this.

I totally agree with this member. I have been there! I don't have time to write as I am going to work soon. I will write later. First, I want to apologize as a couple of times I told you I was sure you would get visa. I know you won't kill yourself as you would not announce it publicly. I felt that way for a couple of days... just wanted to kill myself. I am in a very good position to understand you. For the sake of your little girl, be strong! I will write later, ok? It is not over! Don't let ONE PERSON determine your happiness and the sake of your marriage! I am sure you are much younger than me, so there is hope !!!

I have freedom of speech, that I can say anything I want of my mind and my feelings. I am really hurt and upset by this. I felt like dying inside, really.

I still can't believe it and don't understand this. I am young than you. I am 29 and my husband is 22( only 7 age difference, not too much!)

our life is in Visa officer's hand.. we already planned the future in Saskatoon as a family, have jobs, so on. our marriage is purely genuine, period. we live together, see each other day, sleep in same bed. I so felt that it is totally over and ruined it.

how I start the process of appeal the decision? how?! how much it cost? do I have to be there for ADR appeal?
Hi Dani! I am back for a few minutes as this is my lunch break. I know you are really hurt and upset. How cannot it be? This visa office is awful! I still cannot believe they refused you! You had no red flags, no? Is there something you did not say in order to understand this refusal? What is your story? How long have you been married or known each other? Is the little girl from your current husband? What did your husband talk about at the interview? Do you know why they don't believe your marriage is genuine? You have to order the notes!!! They contain all the data during the process of your application plus the notes taken during the interview and the reasons why the VO denied you the visa.

I understand you feel it is totally over. I felt the same way. I was in a worst position than you as I was 48 at the time my husband was denied visa. When you receive such a blow like this close to 50 years old, you just feel like giving up and you feel it is not worth the battle. I would have given anything to be as young as you! Your life is not over, it is just ON HOLD. For a couple of months, you will go through feelings of depression, then eventually you will snap out of it. Cry and yell, don't keep it inside. I don't know how is your husband right now and how he reacts to the whole thing. I got it hard as my husband shut down. I felt utterly alone during this ordeal. I felt that something died in me. Believe me... you will come back to life! A new you will emerge.

As I said before, don't let ONE person to determine the course of your future. And if you kill yourself, you will break three people's heart: your little girl, your husband and your mother, just because your heart is broken. Is it worth it? NO! What is best? To go through this nightmare for some months or be separated forever from your husband? Look... you are lucky to be in Saskatchewan. If you were in Toronto, for example, do you know the waiting time to get an appeal date is 18 months? In less than 6 months we got full hearing.

There are two possibilities. Once you fill out the notice of appeal, the board will decide if you qualify for ADR or full hearing. If it is ADR, it is you alone. If it is full hearing, it is you in person and your husband on the phone. The cost of an immigration consultant is $3000. You can do monthly payments like I did. Usually people win the appeal.

So, for some months you won't be with your husband. You know what I did to keep my sanity afloat? I set little goals, one for each month. Keep busy! Time flies fast when you are busy. So, if you set little goals and you achieve them one by one, you will have a feeling of pride and accomplishment. It will help you develop your strength as the hearing or ADR is tough, quite tough! It is like going into the arena with lions ready to reduce you to pieces.

You will receive a copy of the refusal letter along with a notice of appeal. The first step is to order the notes, then the second step is to send this notice of appeal to let them know you want to fight this. Take care of yourself and don't look too far ahead, one day at a time! I am here to assist you in any way I can. You can also read all my past posts and there is this thread where you can find valuable information:

Hi...
I am still really hurt and upset, I couldn't stop crying all day long- now I have bad headache! :-/

yes the visa office is horrible, I agree. My mother, I and my husband couldn't believe that they refused us! no red flags nothing. He have clean criminal records. We provided lot of evidences such like email messages between my mother and my husband to show that he keep in touch with my mother.

my husband and I first met last year on July 14th while visiting Marrakech with my deaf friend. I instantly knew that he is one for me and fall in love with him. We got married last year on Septembre 29th, we just celebrated one year marriage anniversavy( went to Thai & sushi restaurant to celebrate).

My little girl is from previous relationship, not with my current husband( no children yet, still trying-no luck). my husband is very excited to be her father and do things with her when we arrive in Saskatchewan, oh well.

my husband told the visa officer that he love me very much and start a future together in Canada, go to school and have a job, have a family of ours. The visa officer asked him lot of questions such like, where is my daughter's father, where he came from and how he come to Canada. VO asked him what's his plan of coming to Canada, and will he stay with me. my husband told her that he will stay with me and have family, so on. nothing wrong with the interview. He really thought that interview was going really well.

you are talking about CAIPS? where I can order it from? I saw some website that sell for just $5? I wanted to celebrate my 30th birthday in January with my husband with my good friends in Toronto ( I lived in Toronto for seven years), bummer :-[

well for my husband, he is really hurt and upset. He said he respect their decision but couldn't understand why they refused us. ours is genuine. we just wanted to be with my little girl and have family, start life in Saskatoon. is it faster to get appeal date in Saskatoon? I read that there's IAD in Calgary, I think. I am not sure if Saskatoon have IAD.

do I really HAVE to be there for ADR the board decide that I am qualify for it?

I would not leave my husband behind. He calmed me down and make me feel better. I loved him so much.. I cannot imagine without him :-[

my husband have to go to Embassy in Rabat to get something? VO told him to write a application or pick up the refusal letter, I think it is refusal letter that he have to go there to get it.
Ohhhhhhh! Do I feel your pain! I could not go to work for 2 days and I had to leave one of my jobs for two months. I think I understand the red flag now. You got married just two months after you met him ??? Wow!

Of course, you have to attend the ADR! How can you defend yourself and answer all their questions? We don't know yet if you are going to get an ADR or a full hearing. You have to order the notes. You can find information on this forum how to order them. Our immigration consultant did it for us.

My husband received the refusal letter in the mail, me too. You are a bit luckier than us as we had to wait two months before knowing their decision. We lost two months :(

I spent my first wedding anniversary alone (December 24, 2011) and to make matters worst I received the notes on the same day. It takes at least one month to receive them. Once you read the notes, you will understand why you got refused.

I am very sorry you were refused.

You do actually have a few red flags. (There's nothing wrong with this - many of us do.) You should make sure these red flags are addressed in your appeal.

The red flags I can see are:

- extremely short period between meeting and marriage
- you are 7 years older than he is (this is unusual in his culture)
- you have a child from a previous relationship (this is unusual in his culture)

I know these probably don't seem like red flags to you - however you have to look at things from CIC's perspective since they are the ones judging your application.

There may be other red flags you need to address. For example: Are you from different religious backgrounds? Do you have different educational levels? Etc.

Hope this helps you to prepare for your appeal and good luck.

Yes, definitely, the most serious red flag is the too short period between meeting and marriage. I know another case similar like yours. That woman is in Montreal, married too to a Moroccan. She got her ADR last year in December and she won. Her husband got his visa in August this year.

The age difference is not much a concern. Only 7 years. If it was more than 10 years, yes I would be concerned as a VO.

And the fact you got a child from a previous relationship. Not common in their culture like the previous member mentioned...

Another question... where was your little girl when you lived in Morocco for one year?
