I moved to Canada in 2003 and became a permanent resident at the end of that year. In 2009, I became a citizen. When I first applied for permanent residency, I listed my dependent child who was under 22 at the time. She was not interested in immigrating, so she did not have a medical exam. I do not remember agreeing that due to not having the exam I would never be able to sponsor her, but it was a long time ago.

Now, due to a lot of family issues, it would be better to have her there, and because I have financially supported her all this time and she has mental and physical problems, she is eligible in that regard. The first question on the checklist is "the person I am sponsoring was declared as my dependent child and was already examined when I applied for a permanent resident visa, and did not receive an immigrant visa (if you have never applied fora permanent resident visa, answer no)" Yes or No
It is yes (declared) and no (not examined), so what do I say? Am I ineligible to sponsor her now?

If she did not complete the medical, then you are unfortunately ineligible to sponsor her. Completing the medical at the time of your original application was required in order to be able to sponsor her in the future.

I guess even if too late you can still sponsor her since she got so many disabilities? On top if she is the last family member has no one else to take care of her , it could be a case. Let us hear from senior or other members here.

Yes, too bad we cannot foresee the future. At the time I applied, her health was not so bad and she could work, etc. Now she cannot and she has no one else to help, so I am spending so much time in the US taking care of her, I may need to just leave my husband and move back. I guess I am not sure what a medical exam 15 yrs ago would mean today anyway. It seems like a strange rule.

if you declared the child who was under 22 at the time as a non-accompanying dependent when you applied for permanent residency, and the child did not do medical exam at that time.......the child not been interested in immigrating does not automatically preclude a non-accompanying dependent from medical exam.....if you at that time agreed that due to not having the exam you would never be able to sponsor her, the child is ineligible.....however, if you did not agree, you may try.......but you should remember how you dealt with the issue at that time.

Was there an option on that at one time? I can barely remember what I agreed to yesterday, much less 15 yrs..I did, however, save all my paperwork, so I can hopefully find how I handled it. Thanks for the info.
I'm guessing that you may have applied for PR under the previous 1976 Immigration Act rather than the current IRPA. I don't know if the non-accompanying dependent medical examination was mandatory then. This is a case that you probably need to take up with a competent immigration lawyer as it has nuances that need to be taken into consideration.

You most likely will not fit the definition based on the information you've provided. To be able to be sponsored, you would have needed to be continuously financially dependent on your parents due to a medical condition that prevents you from working / living independently. If you worked for a few years after 22, then this would generally mean you don't qualify.

How old are you now?

Where are you living now? Are you living independently?

How did the rest of your family get PR and when? Were you included in their application and did you complete a medical as part of that process?

I am 32 years old and from Iran. I always lived with my family and received housing support.

There's no chance your mother can sponsor you unfortunately. If you want to immigrate to Canada, you would need to qualify on your own through an economic immigration program like Express Entry (like your brother).

Think you are misunderstanding what IRCC means by financial support. If you had not ever been able to work, care for yourself, live independently, etc. and have always been cared for and been financially supported by your family then you would be considered as being financially supported by your family and be able to be sponsored after age 22. The exception is really meant for people who have lifelong disabilities like being developmentally disabled.
