Hi All,

I am a British citizen & my wife is a Canadian citizen. We are living in the UK with our 3 kids all were born in the UK as British citizen.

(1) When my first child was born, my wife was a Canadian PR holder then she became Canadian citizen after 6 months in 2010.
(2) My other 2 children were born after she acquired Canadian Citizenship.

Kindly advise if my children can become Canadian citizen while applying from the UK as we do not have a plan to move to Canada at this stage.

Thank you very much.

I'm pretty sure that the kids that were born after she became a Canadian they are automatically Canadians as well. You should have registered at the Canadian embassy in London. I think in the case of your first child you should go to the cabs find embassy and they should be able to help you out.

I believe that the first child has currently no status in Canada at all. This means that your wife will have to sponsor the child for PR status first.

Your wife was earlier a PR in Canada holder, and i guess she became a Canadian Citizen by Naturalization.

Your 1st Child may have received Canadian Citizenship as a child if the mother naturalized her by applying for her citizenship when the mother applied to become a Canadian Citizen by Naturalization in 2010......otherwise, the mother may have to sponsor the child for PR in Canada.

Your 2nd and 3rd Children are likely Canadian Citizens because they were born after their mother became a citizen.......the 2nd generation limit rule for children born abroad does not apply in their case if their mother became a citizen by Naturalization........as they were born abroad, you may have to apply for their proof of citizenship.

See if you may be a citizen.......

She has to be born in Canada or a naturalized citizen to Canada

Permanent Resident status
Regardless of your age, if you are applying for citizenship, you must have:

Your PR status must not be in question. This means you must not:

  • be under review for immigration or fraud reasons
  • have certain unfulfilled conditions related to your PR status
  • be under a removal order (an order from Canadian officials to leave Canada)
You don’t need a valid PR card to apply for citizenship. If you have an expired PR card, you can still apply for citizenship.

Hi

1. Your first child is not a Canadian citizen because s/he was not born to a Canadian citizen or born in Canada. Your wife would need to sponsor the child, which would require proving that she is returning to reside in Canada.

2. Your 2 other children born after your wife became Canadian are Canadian citizens. Apply for their Certificates of Citizenship.
