Hi, Im not sure if this topic has been discussed, i could only find topics from 2006 nothing recent.

im sponsoring my spouse, and once he gets permanent residence he would like to sponsor his brother at that time he would be 18.
im wondering if anyone knows how long approx it would take to sponsor a brother??

Which province do you live in?
Well we will be living in BC but if if makes a difference my family is all in Alberta so we could go live there too.

Is there a restriction against this?
how come you can sponsor parents, or adopted brothers or sisters, but not real brothers?

i have a friend who just arrived in canada from the phillipines

his brother a canadian citizen just sponsored him and his father at the same time.

is there rules against how you can sponsor family?

Yes there are rules on sponsoring other family members. To be eligible they would have had to have undergone a medical and police check when you and your spouse filed your application. If this was not done, I dont think you can sponsor them at any time. Processing times for Grandparents and parents are 31-55 months, so not sure if a brother/ sister would fall in to that catergory (I would assume they do). Have you looked in to other visa programmes that his brother may be eligible to apply?

Your friend came as a dependent of his father - his brother did not sponsor him directly. In other words, your friend was able to immigrate as a result of being his father's dependent. (Note that parent / grandparent sponsorship has actually been halted as of late last year and CIC is no longer accepting application.)

Unfortunately neither Alberta nor BC have provincial nominee programs that would allow your spouse to sponsor his brother.

However if his brother applies to immigrate independently through the skilled worker program, can obtain additional adaptability points for having family in Canada.

hmm. No he didnt undergo those checks. we listed him on the application but thats it. our immigration consultant didnt tell us he would need those to be sponsored.

kind of. i was looking at student visa. but my spouses family is from mexico. so for them to afford to pay his school in canada may be difficult.

but to be a skilled worker do you need to have a degree in a trade of some sort?


also the dependant thing, if my spouse were to sponsor his mother would his brother be able to come as a dependent even though he is over 18, but still living with her and such?
(yes i saw they stopped accepting applications, hopefully in the 2 years they will accept them again)

Several points of correction:

1) You can only include dependents when you file an application (you cannot include random family members you wish to sponsor later - it doesn't work that way). This means that unless the 18 year old brother was an orphan and essentially adopted by his brother at the time when the spousal application was filed - he could not have been included in the application.
2) Parent/grandparent applications are no longer being accepted. This freeze began in November 2011 and is expected to last two years.
3) Brothers/sisters do not fall into the same category as parents/grandparents by default. When parent/grandparent applications were still being accepted, brothers/sisters could be included in parent applications if they qualified as dependents.

It was not possible for you to include the brother in your spouse's application.

Yes - he would need to meet the skilled worker application criteria. Right now that means he would need to have a job offer in Canada in order to apply and also meet additional criteria. More information here: http://www.cic.gc.ca/english/immigrate/skilled/index.asp

The parent/grandparent sponsorship rules are expected to change significantly when this category reopens in a year and a half. So there's no guarantee the brother can be included if the mother is sponsored. However if you want to give it a try, he should continue to remain his mother's dependent (i.e. live at home, stay in school, don't marry, etc.).

by included in the application. i mean they ask for your brothers and sisters and you write down the names of them and birthday and stuff. so immigration knows how many immediate family members you have.

anyways okay thanks for the link to the skilled worker.
well he is only 17 now and still finishing highschool.
so i think he will be a dependent of hers for a few more years. especially with how the economy is in mexico (very bad to say the least, even with a college degree and work experience in the field its nearly impossible to find a job.. but thats another story :) )

well i guess we shall just wait and see what the changes are for the family class in the next couple of years and decide what to do at a later date.
