I want to inquire about the case of my daughter who is currently 2years old. She was born after I became a permanent resident but while I was outside Canada. Therefore, she is not a permanent resident like the rest of the family members. As I am planning to go back to Canada to settle there permanently, I am not sure what to do about my daughter as she does not have the permanent residence card. Can you please let me know (1)the kind of visa she needs in order to enter Canada, (2)if I am planning to go to Canada in June, when should I apply for my daughter’s visa, and (3)how long is the processing time? And finally, (4) what should we do in order to get her the permanent residence status.

2.you can apply immediately after reaching canada but if there is job would be better but thats not compulsory kids

4start with upfront medicals for your daughter

Another question Is your spouse in canada already if father in canada and can sponsor it would be ideal for mother to stay with baby until visa processed

Do you meet the RO?

1. You can apply for a TRV. If that is refused, you can apply for a TRP. If that is refused, the child will need to remain outside of Canada until becoming a PR.

2. You can apply for a TRV/TRP whenever you want. As a PR, you must be in Canada to sponsor your child.

3. The PR app will probably take around a year or so.

Meeting the RO is very important. You have to meet it in order to sponsor your child. You also have to be in Canada in order to sponsor your child.

You have to take into consideration, if you can still meet the RO, you might have to go back to Canada sooner and let your spouse handle the application for the child's visa. That or your spouse goes to Canada to sponsor and you stay with the child and take care of the visa. Otherwise you will have a problem with the sponsorship.

Thank you for your reply. This is very useful. If I go to Canada In December 2016. I will be only 2 months short of my RO. When should I apply for my PR card renewal. Suppose my child is approved for a TRV and gets into Canada. Can I sponsor my child immediately upon my arrival into Canada? How can I show my intention to reside in Canada and meet the 2 years requirements. Will I be able to apply for sponsorship Before I meet the RO. Thank you

When did you become a PR? How long have you been outside of Canada?

It may not be possible for you to sponsor your child until you meet RO.

2 months short is still short. If you are able to enter Canada without getting reported for not meeting the RO, you would have the option to bring your PR status back in good standing by meeting the RO before you apply to renew. In some cases, for example if you had been outside Canada for more than 3 years straight, you would not be able to meet the RO until you stay for 2 years straight.

If you however try to apply to renew your PR card or to sponsor your child while you don't meet the RO yourself, you are bringing yourself to the attention of immigration. Other people have done this in the past and been called in for interviews and asked to explain why they do not meet the RO themselves. Doing this is risking your PR. However, if you had humanitarian grounds for why you had to stay outside Canada, they will usually let you keep your PR.

So if you want more information, you can list the periods you have been in Canada in the past 5 years or after you got your PR and we will help you figure out when you can meet the RO. Also you can tell us why you did not return to Canada sooner in order to meet the RO and we can try to figure out with you if this reason could fall under humanitarian grounds.
