Sponsorhip and divorce

I have been married for over a year now. My husband and I married in Canada and shortly after (2 months) I applied for a spousal sponsorship within Canada. I am born and raised in Canada and my husband is from India. Our marriage was arranged without force from either family's side. Unfortunately, as someone born and raised here, married to someone born from India, we have had trouble in our marriage from the start. The cultural differences have been hard on both of us. We have agreed that neither of us is happy in our present situation and have been talking about seeking a divorce. He has recently had his sponsorship application granted, would a divorce affect his ability to retain his new immigration status?

If he'd already gotten his PR it would not be a problem. He has first stage approval at this point only?

pjkd... just wanted to make sure that you are aware that you are still responsible for him for the entire undertaking (3 years). The agreement you signed is still withstanding and cannot be cancelled, revoked or voided.

If you choose to cancel the sponsorship, contact the processing office (Vegreville I beleive) ASAP to let them know you wish to cancel. If not, remember that you are responsible for him for 3 years and cannot sponsor anyone else for the duration of this undertaking.

How am I responsible for him? In terms of finances, he is in a professional position making about $100,000, whereas I am making about $40,000. We have been renting and don't own any joint property or investments.

Will I be able to remarry within the 3 years? I don't plan on sponsoring anyone in the foreseeable future, as I don't plan on marrying anyone outside of the country or anyone who has not already settled himself in the country independently.

Should he lose his job and toddle down to the welfare office and get welfare, even in the case that he needs to go on disability, the government will go after you to pay every cent they pay to him but that is something I am sure you knew about when you sponsored him. Nobody will stop you from re-marrying within the 3 years.

So, if he already has PR, he's here to stay, if he only has first stage approval yet, they will probably cancel his application if you divorce him now.
