Hello everyone,

1. I have been outside Canada more than a year, now I want to sponsor my wife and come back Canada with her. Should I apply to sponsor my while when I am still outside Canada or Should I come back Canada first and apply that? I heard that I should come back Canada and even should get a job before applying, that will be more likely to be approved. We really not want to be separate. Please advise,

2. How to prove that I will return Canada once she became PR?

3. Is it very likely my wife can receive temporary visa to visit me during the application process?

If youself is PR, you must come back to Canada and apply. Btw, your plan to live with your grandparent changed?

Only a citizen can sponsor while living abroad. If you are a PR you need to return to Canada then file the application.

Either way works. If you are living abroad for a while you may as well apply Outland (so the process starts now and will be almost complete when you go to Canada). Alternatively if your plan is to return to Canada immediately then Inland would be the way to go.

2. How to prove that I will return Canada once she became PR?
We didn't "prove" anything. We simply stated that we would be moving to Town X and that we planned to get a job as Y. Obviously if you own a home in Canada or have a lease already then that is proof... but most people wouldn't have a signed lease or a job offer a year before they move.

3. Is it very likely my wife can receive temporary visa to visit me during the application process?
Impossible to say. That will depend entirely on your wifes situation and how you complete the application.

assuming that OP is a Canadian citizen, yes he can sponsor while staying aboard.
Inland only works if OP's spouse has visitor visa approved or if she only needs eTA to travel to Canada. WIth a spouse in Canada the approval rate of TRV is 50/50.

If you are looking to buy or rent a place to live, you can get one while you are outside Canada. You don't need to leave your wife alone if you don't want to. There are websites where you can view them virtually.

You can come back partway through the process or submit proof that you are moving near the end of the process by giving notice at your jobs, house, etc. and looking for new jobs, homes, etc. There are many posts about what type of proof is needed.

Things have changed. Because so many people weren’t relocating people now need proof they will be relocating.

Thanks for your advice, can I apply now with the marriage certificate and provide the wedding photos later as the wedding will occur next year? I want to save time. Also, when I come back to Canada to look for job or house, can I update that on my application?

If your wedding picture are from a ceremony next year then IRCC will likely question whether your court marriage is actually your true wedding. Will you be declaring on social media and to friends and family that you are husband and wife after the court ceremony? Will you be living together after the court ceremony?

Yes, after the wedding or court ceremony that will occur in our home country, I will declare on social media and my family, friends, I plan after the wedding and submitting application, I will come back Canada to look for job first (my wife is still in home country waiting for the application process since she does not have visa to Canada) as I think that will make our application more convincing, proving that we really want to live in Canada. Do you think that makes sense?

Sorry I though a certificate and court marriage were the same thing. If you have aero ceremony and only a marriage certificate you must wait until you have your wedding u til you can apply to sponsor your spouse. URCC is very aware of all the wedding documents, ceremonies, etc. and see many couples try to submit their applications early so they will be able to leave for Canada together after their wedding. We have seen many try what you are suggesting or something similar and IRCC will refuse the application unless they can see that all ceremonies have been completed and you have pictures. You don’t have to return to Canada right away if you don’t want to. You can submit evidence of relocating to Canada while remaining abroad abroad or return to Canada 3/4 ways through processing and send a webform to IRCC indicating that you have come back to Canada to work (including proof of employment or lease, etc.) and establish yourself so you can be ready for your wife to join you as soon as her PR is approved. Returning to Canada will make it much easier to prove that you are both planning on coming to Canada once she has PR.

You also look for internal transfer especially if you are working for a Canadian company in your wife's country. This way, you don't have to leave your wife alone.
