I am a new PR in Canada and starting working on a decent package in Jan 2019. My wife and child are in France. She is currently working in France. When I had applied for my PR, I had mentioned both her and my child as non accompanying dependents because at that time i was not sure about the job market in Canada. Now that i have a job, I am in the process of sponsoring her and my child. However, i had couple of queries,

1. Would it be better for her to come here on a 6 months visitor visa first and then I put in my application for her PR under the Spouse in-Canada class and also put in an application for her Open Work Permit at the sametime. Because the documentation says, she can stay here until her PR application is processed even though her visitor visa might end in 6 months [ is this true ?] . So even if her OWP comes in say 8 months, it is fine for me since I have a decent job. how long would the PR approval take in this case ? Also, is this legal and not frowned upon by the immigration officials. I read OWP comes in about 4 months ? is it true ?

2. Just sponsor her under the Family Class - Outside Canada process. And once the PR process has started, she can then apply for her 6 months visitor visa. state that we have a pr application in process while applying for the visitor visa and visit me for six months and then go back to France and wait for the final PR approval. How long does Family Class outside canada process take ? And once PR process has started, can she even apply for a visitor visa [ dual intent stuff ] ?

Also, in this case, what happens if her PR approval does come before her visitor visa expires. will she then have to goto France for the final stamping or can she just goto USA and back for the stamping or will it be done here in Canada itself.

You can apply either Inland or Outland depending in you. If you apply Inland she needs to remain in Canada for the duration of the application. Will your daughter be coming as well you didn't mention that?

If you apply Outland she can be with you inside Canada and remain here you just have to apply to extend her visitor visa and if approved no problem.

If she is here and she gets her approval you can do a flagpole to the USA and get it stamped when you return.


So basically she can come and you can apply outland even if she is here. Please know if you apply outland and she requires an interview or biometrics these cannot be done in Canada. Biometrics can be done in the USA but interview will be required in homeland as they assume she will be there.

Just to be clear:

Note that the chances of your wife and child being approved for TRVs is very low. Before you even try to make the decision between inland and outland, you should apply and see if they even get approved. If they don't, then outland is the only option.

getting any visa rejected is not a good option.. i was initially thinking of applying under the outland category and then once the applications are under process, then i intend to apply for a visitor visa [ trv] for both so that they can atleast stay with me for 6 months and then go back to france and wait for the official pr approval. is that a safe way ?

You can try but chances of a TRV are low regardless.
