Sponsor refusing to support...what do I do?

My daughter and I became permanent residents Nov 2, 2001 with a 10 year undertaking signed by my husband. Since that time I worked and basically supported the whole family till we split this feb and I went to a shelter for abuse. I am now too ill to work and need support from him and he refuses. I applied for social assistance but we all know that is not enough to live on. I went to legal aide they say contact CIC and then call CIC they say hire an attorney, how with no money or support. Anyone got any ideas for me?

Legal Aide says this is not a legal aide issue so they will not even do an application. I do not talk direct to him as there is a restraining order, but thru his attorney he says he will not pay any bills for me or my daughter since we are no longer living together...and to be truthful he has NOT paid any bills for us since Nov 2006 when he chose to quit work. Now I am too sick to keep it up and feel at a loss. Oh well I am alive that is one good thing!

Is your husband your daughter's father? If so, he has a support obligation that can be enforced by the court. There are certainly local agencies to help you with that. If he isn't her father, he may still have an obligation for your support. Is there a domestic violence shelter or counselor who can help you?

If he sponsored you and your daughter, he has a legal obligation to support you for 3 years and your daughter for 10 or until she turns 25, whichever happens first. He is therefore no longer obligated to help you since 2004 but your daughter until 2011 unless she is 25 already.

You can try to look for a lawyer who will take the case on a percentage but if your husband is not working, he may not have any money to go after. You could also try a newcomers centre. Not that you are a newcomer anymore but sponsorship is an immigration issue and some newcomers centres have access to legal aid.

Otherwise, it's a divorce case, you can try to get alimoney but again, if he doesn't have any money...
