Sponsor Questionnaire Form IMM5540 for Quebec residents

Hi all,

My wife, who lives in Quebec, just received her sponsorship approval from CIC. My application for PR has been forwarded to the visa office in Berlin. We now have to submit an undertaking application to the MICC of Quebec.

So far, so good.

However, the Sponsorship Approval letter states:

Please note even though your application has been forwarded to the visa office, the following item was not included with your application package, therefore your submission is considered incomplete at this time:

- The Sponsor Questionnaire Form IMM5540. You must complete, sign and date this form.

To avoid further unnecessary delays, please forward this document directly to the visa office indicated above along with a copy of this letter. Please do not submit this supporting documentation to this office as it will only be returned to you.

We didn't include this form in our application, because the guide for sponsors (Guide 3900) states that residents of Quebec do not need to complete this form:

Who must complete this form?

This form must be completed by persons who want to sponsor a spouse, common-law partner, conjugal partner or dependant children

Note: You must not use this form if you or your spouse, common-law partner or conjugal partner has a dependent child who has child of his own.

You must obtain and complete a Financial Evaluation (IMM 1283) form and its instructions (IMM 5482), available on our website or by contacting our call centre at 1-888-242-2100.

Residents of Quebec do not need to complete this form.

Has anyone had this before? Do we need to fill in IMM5540 after all and send it to the VO? I don't really see the point, as sponsorship approval has already been given.

Good question--my wife is sponsoring me from QC as well, and I wasn't planning on including that form with the application. Maybe I should...

I have heard of people including the form but writing N/A in all the spaces. Can anyone comment?

i'm not sure which guides state that (the old or new) but i followed the checklists and this form was required even for residents of quebec; this form has actually questions abt the relationship (if the applicant met the sponsor family, if the family knows abt the relationship) and abt the sponsor background (education, addresses, workplaces, income, ties with canada if the sponsor is outside etc) so for me it's strange that u got ur approval without this form :/

also at the end of that form u r encouraged to add any detail abt the relationship and many sponsors actually write an essay and it's something which helps a lot in determining that u r genuine

the only thing not required for quebec sponsors is the sponsorship agreement and the financial evaluaton; the first one because the agreement with quebec has priority and the second again because quebec will evaluate u financially (it does not really matter at federal side)

i guess the one who put that in the guide still needed some caffeine

The checklist does not say anything about QC residents not needing to do this form.

The exact wording from the guide (3900) is:

With a closer look, it seems like the "residents of Quebec do not need to complete this form" refers to the Financial Evaluation (IMM 1283) form and its instructions (IMM 5482) referred to in the previous line, and NOT to the Sponsor Questionnaire (IMM 5540).

Very confusing, I would have mailed mine without catching this if this thread wasn't made.

Follow-up...I just did some digging in the instructions guide (3900). It includes the following section:

Sponsors living in Quebec

The province of Quebec is responsible for determining whether sponsors living in the province have the financial ability to sponsor family members and the length of the undertaking.

Sponsors living in Quebec or currently outside Canada but who intend to reside in Quebec upon their return must only complete the Application to Sponsor and Undertaking (IMM 1344) and provide the required documents.

Of particular interest to this thread is the last line.

I'm going to include the Sponsor Questionnaire (IMM 5540) anyway, just to be safe, since the OP was asked for one. The worst they can do is throw it away. But I'd be interested in hearing from other prospective QC immigrants and their sponsors who may have input on this.

Hey guys- I have sent my application in December. I know its kind of confusing with the form
IMM5540- (Questionnaire)- but you MUST fill it out and include it with your application!!!!!!!
My husband is a Quebec resident by the way, so I also have to send out the extra forms.

But anyway- the IMM5540 form is very important because it asks the applicant questions about the relationship and wedding, Quebec residents are NOT exempt from this!! Must include it with your application before mailing it!!!!

Yes, "Residents of Quebec do not need to complete this form" probably only refers to "You must obtain and complete a Financial Evaluation (IMM 1283) form and its instructions (IMM 5482)".
My wife called CIC and they also recommended her to complete the form and send it to the VO, so that's what we will do.
