HI,

Me and my wife both are Canadian PR holders since from December 2014. My baby born in India in august 2017. Currently I m working for Canadian employer and currently I am in India and planning to process PR for my baby and will stay here until the process is done.

Will CIC allow the PR application while I am out of Canada?
How long the process will take ? Just an approximate duration so that I can plan if I can stay or come back to Canada.

Thank you.

No - you cannot sponsor your child from outside of Canada. Either you or your wife must be physically in Canada when you submit the application to sponsor your child and you must remain in Canada while the application is being processed.

The process will take around six months.

No, as a PR you must be residing in Canada to sponsor any family members including your child. If you try to sponsor from outside Canada, you can expect the app will be rejected. So you must submit the app while in Canada, and remain living in Canada for duration of processing. You can leave for short/temporary vacations only.

I would budget 6-12 months in total for the app. Better to check New Delhi thread for more accurate times.

Hi,

I'm in the same situation. In this case, if my spouse and I, must be in Canada to sponsor, what's the baby visa to get in Canada?

The new baby must have a tourist visa?

Thanks

Note also that working for a Canadian employer in India does not necessarily qualify you for an exemption to the RO. Your employment will need to be under very specific circumstances.

So you may need to also watch for you and your spouse's residency obligation if she needs to remain in India (if baby is not able to get TRV/TRP to come to Canada also).
