Sponsor nephew

Hi,

Guys i really need to help this lady out so i need your help. It's regarding a lady who is around 60yrs of age and has only one son (32 yr) who is not in stable condition mentally and in last stage of cancer. She is Canadian citizen and well educated.

Keeping the present situation in mind she wants to sponsor her nephew, age 26 and an electric engineer. Is she eligible to sponsor her nephew? What would be the procedures?

Please help.

If she lives in Manitoba or Saskatchewan and has lived there for at least one year, she can sponsor her nephew under PNP family stream.

If she is not living on SK or MB, she can not sponsor him unless she has no other relatives in Canada or other closer relatives elsewhere that she is eligible to sponsor. That is, if her son dies and she has no other family in Canada and no husband as well as no other closer relatives she is eligible to sponsor like parents alive somewhere, then she would be able to sponsor him.

Her nephew can also apply under the skilled worker program if he gets a job offer and he would get extra points for his aunt.

I heard that Quota for Engineer category is full then in this situation what else he can do?

I'm Italian and got many years experience as a chef- cook.

Planning to emigrate to Canada with my Family, two kids a my wife wich is brazilian and eventually my mother.

I was advised to apply for a skilled worker Visa from David Cohen. Is my resume sufficent as a proof of eperience? whaty will I actually need in order to succeed with my application?

Have heard of any other person in my same situation.....we are really planning to Canada but it seems so difficult and so confusing everyone has a different experience and each case is differrent from another. We may also try to go on a tem permit but don't want risk, we may have to go back later on if don't get extension or PR from inside Canada.
Is that correct?

Please advise me, on the right direction we have to take.

The quota for the engineering categories is definitely not full and CIC is still accepting applications. See NOC 7241 and 7242 on the following page:

thanks for ur reply. Poor lady called an immigration consultant and ask her if his nephew can apply under skilled worker category; Electric engineer, and the consultant said NO quota is full. :-X

Sorry - I was posting too quickly earlier today. These categories are for electricians. So it will depend what type of training and experience he's had.

Oh - if he's a fresh graduate then he won't qualify for the federal skilled worker program (you need actual experience to qualify).

I can't see any way for her to sponsor him. Maybe someone else will.

What about coming over on a study permit? It's expensive to study as a foreign student. But once you finish, you qualify for a post graduate work permit. And once you have accumulated the right kind of experience, you can apply for PR through the Canada Experience Class.

Applying directly for PR via the skilled worker class is more secure than a work permit. If you are on a work permit and get laid off, you would be scrambling to find a new employer who is willing to apply for your labour market opinion and wait for you to be able to get it as well as your new work permit before you can start during which time you may have no income. If you are a PR, you look for a new job, plain and simple, no permits needed.

To verify your experience as a chef, did you always work for yourself or you work for a restaurant? If you worked for a restaurant, you had a boss who can write a letter. If you worked for yourself, surely there would be people in the community who can state that you ran that restaurant. You would have had suppliers and you would have had customers and your restaurant would have had neighbours, businesses or apartments with people who saw that the restaurant was there and saw you there and probably ate there at some point. Any such person could write a letter which would be better than nothing and especially should the person be a judge, lawyer, doctor or dentist, their letter would have a bit more weight with immigration.

If she has brothers in Canada, there is no way she can sponsor him under the federal system even if her son dies. If she wants to sponsor him, she has one option and that is to move to SK, live there for 1 year and then apply to sponsor him. He needs to use the time in the meantime to gain 1 year of work experience to qualify. For Manitoba, he would need 2 years experience.

Aside from that, he would need a job offer in Canada if he wants to immigrate or even just to get a work permit and work on his immigration later. Does the aunt have any contacts that can get him a job offer? Even then, with no work experience, there is no guarantee he would get in. He needs at least one year for most purposes.

Like Scylla said, if he qualifies for a working holiday program (find out at the Canadian embassy where you are), he could get a 1 year open work permit to go to Canada but during that time, he will have to find a way to stay, get a permanent job, employer who wants to keep him and get a regular work permit.

He could also go the way of doing a 1 year degree on top of his studies on a study permit and then get a 1 year open work permit and hope he can find a permanent job during that time. Better if he does a 2 year degree and gets a 3 year open work permit, then he can apply himself under Canadian experience class.
