Sponsor is in house arrest because of production of Marijuana. Any chance?

Hi everyone,

I would like to ask if anyone of you here or know someone that have a succesful application to sponsor despite of criminal record. My sponsor is currently in house arrest because of production of Cannabis. But he is allowed to go out of house to work, grocery and other very important matters.
Is he still be eligible to sponsor me?

My assumption would be no, perhaps when he is finished and has served his time but I would highly doubt this possible while on house arrest since he is essentially serving time, here is what the government site says:

You may not be eligible to be a sponsor if you:
•failed to provide financial support you agreed to when you signed a sponsorship agreement to sponsor another relative in the past
•defaulted on a court-ordered support order, such as alimony or child support
•receive government financial assistance for reasons other than a disability
•were convicted of a violent criminal offence, any offence against a relative or any sexual offence—depending on circumstances such as the nature of the offence, how long ago it occurred and whether a pardon was issued
•defaulted on an immigration loan—late or missed payments
•are in prison or
•have declared bankruptcy and have not been released from it yet.


It just depends if they put house arrest and being in prison as the same thing.... its not a violent offense, so hard to say

hi there,


i had to make you more sad,,,,but working in court at all the times,,people who have criminal record are unlikely to be approve for anything.....until he proves(few years later though) that he is clean,,maybeeeeee or never can sponsor anyone in your case.


I am sorry about bad news,,but canada is very sharp for people with criminal charge,,or weapons or anything against the law......

@missmymexi & rezi : thank you for giving time to reply. My partner was charged in 2007 but the sentence was given this 2011. His house arrest is only 6 months. Our criminal lawyer says his case can still sponsor but i dont know now. Im confused, actually we did not submit yet the application. I dont want to be apart again from him especially that we have a new born baby.

One more thing, when i apply for visa extension I mentioned there that my partner is in house arrest. But they still give me extension for a year.

The house arrest is almost over, so I suggest you send in the application once it is over. I don't know if CIC would consider house arrest to be prison, but even if they do, it will be over soon.

Yes it over next week. And our plan to send the application next month. I call the CIC and told them about the case and they said yes he can still sponsor because he was charge 4 years ago.

I also read through research in net that house arrest is not in prison. ..Ahh its really complicated.

But anyway I think the best now is try to submit the papers and just pray for God`s grace.
