Hi

I would like to have an advice on this situation , I sponsored my husband who is living in the US since last year sept 2012.He is under work permit and also was waiting for his refugee paperwork which was cancel finally. We continue with the process for the canadian residency. Now his status will expires in one month in the US and we are been invited for an interview in Jan 2014. He couldn't assist cause He will go back to his original country. What can we do, they can't transferred his files cause they stated in the interview's letter, they won't transferred even you can't have the US immigration paper.

please help

Your husband will have to try to apply for a US visitor visa once he's back in his home country so that he can attend the interview in the US. If your husband is a former refugee claimant in the US, then it's probably unlikely the US visitor visa will be granted. But you can certainly try.

If the US visitor visa is not granted and your husband does not attend the interivew, a decision in his case will be made without interview. Unfortunately this likely means that the decision will not be in your favour.

Rather than waiting trying to apply for the US visitor visa and then waiting for the file to be processed with or without your husband attending the interview, another option would be to withdraw your application and file it again with your husband's home country as the visa processing office selected. This is what you should have done with the original application.

I don't have a specific answer for you on this. Initially, you should have allowed him to visit you in Canada before you file PR for him. As long as he has Status in the US he will be allowed to visit you in Canada. This problem will not arise.
