Sponsor Common Law Spouse living in CDN, outland via Buffalo?

Hi Everyone,

I have a ton of questions and hope you can help answer some of them...they are so many as I split them up instead of asking all kinds of stuff in 1 question.

Here’s are some details to our situation:

- 1st study permit was from May ’09 to Dec ’09 and extended then until Aug ’10
- we have been living together since June ’09
- we would therefore like to apply for PR as soon as the 1 year is full (June ’10)


1. As far as I understand it is possible to sponsor a common law outland through Buffalo "if you have been lawfully admitted to Canada or the United States for a period of at least one year"...does that mean a 1 year permit or 1 year in total or 1 year going forward from the time the application is submitted?

2. What happens if the study permit expires while the application is being processed in Buffalo?

3. Would it be possible to apply for an open work permit at the same time when submitting a PR application to Buffalo?

4. Which application form is used when submitting to Buffalo, Inland, Outland or Generic?

5. Aren’t there region specific application forms required for outland?

6. Can a medical be submitted together with the PR application or do we have to wait until they request it?

7. Can the medical be done in Canada when submitting to Buffalo?

8. Can the Police certificates be submitted with the PR application or only when requested?

9. What importance does the financial situation have when sponsoring a common law spouse?

10. I would like to sponsor my common law spouse but I myself haven’t had any income for over 12 months…but I do have savings and therefore never have needed any kind of government support. What impact does that have on the sponsorship?

11. When submitting an application to Buffalo is everything done by mail or is travel required during the process? We live on the West Coast.

1. Has to be 1 years admission, it appears that you were originally admitted for 6 months, so you can't apply to Buffalo.
2. You apply for an extension to Vegreville before it expires.
3. No,only "in-Canada" spousal applicants are entitled to an OWP after they pass 1st level approval.
4. Since you can apply to Buffalo, you use the forms for your country of residence. See: http://www.cic.gc.ca/english/information/applications/fc.asp

6. You have to submit the medical and the PCC plus attachments to the application and the sponsorship is sent to Mississauga.
7. As you won't be submitting to Buffalo, it can be done in Canada.
8. Submitted with the application.
9. Can't be bankrupt or collecting welfare or failed to provide financial support for previous sponsorship.

11. You really should read the instructions, a complete package is submitted to Mississauga, and they forward the application to the overseas office.
12. If an interview is required, you would have to attend the overseas processing office for it.
