Hi

We (myself, husband and my child) were Indian citizens and got Canada PR cards. We did our landing together. To cut the story short I stayed back and met my 2 out of 5 year residency rule. But my husband and child of 11 years did not. Further without my consent he went ahead and applied a European citizenship for himself and my son. So when they landed they were Indian citizens but now when their PR card has expired they are Portuguese citizens with expired Canada PR card.

I am still India citizen and who meets PR residency requirement. During these 2 years I also worked in IT company in Canada and paid taxes.

I am missing my child very much and want to bring him now to Canada. My husband now has no objection to this. My question is:

1)Can I file for re sponsoring my child for new PR card as his PR card is expired? Do I need to be in Canada to file the PR card sponsorship?
2)How much time is required to process child sponsorship?
3)Since my child has acquired European citizenship will it affect his re sponsorship?
4)If I bring my child with expired PR with me via USA land border and he is allowed to go through and not reported even then with expired PR card can he get admission in school?

regards

Have your husband Apply for a PR Travel Document for your son. Since he was removed as a minor (and still is), I believe he'll have the PR TD approved based on H&C reasons. With the PR TD your son can return to Canada, and then immediately apply for PR card renewal.

For schools, you'll need to contact the individual school you want him to go to, and ask what their policy is around proof of PR status. Some may demand to see nothing short of a valid PR card, others may be much more lenient.
