Hello Friends,

I just have become Permanent Resident of Canada. I have my 10 year old nephew who is in India currently in Grad 4. His Parents are also in India. My nephew and his parents are neither Citizen nor Permanent Resident of Canada. However I want to sponser my nephew here in Canada (Regina, Saskatchewan) so that he can continue his study here from Grad 5.

My concern is his parents are not financially that strong and as per Regina Public School policy, my nephew need to pay $ 11, 200 tution fees per annum as an International student, which is very big amount considering his financial position.

Can someone please advise what are the ways I can waive Tution fees for my nephew OR I can sponser him as Permanent Resident ? What is the procedure to adopt him ?

You can't sponsor him as a permanent resident unfortunately. If both of his parents were deceased, then adopting him and sponsoring him could be an option. However since both of his parents are alive - this isn't a route you can take.

If you would like him to attend school here, then he will need a study permit and his parents (or you) will need to find a way to pay the $11K/annum tuition.

You may have posted this in the wrong thread as you are talking about a study visa for your nephew. This thread deals with family PR sponsorship. You cannot sponsor your nephew for PR family sponsorship for the purpose of going to school here. You can only sponsor your children or parents/grandparents. The parent/grandparent sponsorship opens in the new year.

Please post this question the study visa forum of the site.

I wasn't giving bad info. OP stated that his nephew's parents are alive. So unless his parents are dead and the OP has no other relatives in Canada. So based on OP's situation, he cannot sponsor the nephew. If the OP had said that he has no relatives in Canada, OP's parents are dead, only then he can sponsor the nephew when the nephew's parents are dead as well.

Actually screech339 is correct. This particular OP cannot sponsor his nephew since his parents are still alive. It is clearly mentioned in your link:
brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned

You cannot sponsor your nephew for PR family sponsorship for the purpose of going to school here.
Maybe YOU need to check....

Oh wait, are you referring to the underlined word there? I hardly consider that making a blanket statement especially considering he was using "you and your" quite a bit through out his post and not once did it say ANYONE can ONLY ...

But then, that is just me, well, and apparently a couple other folks here, that can clearly see he did not make a blanket reference to ALL applicants ...

Guys, Is there anyway I can bring my Nephew here in Canada considering the fact his parents are alive and non-immigrant to Canada ? I would like to have rest of his education here in Canada ? I can call him upon on study permit, however $ 11,200/annum tution fees bugs me a lot for 7 years.

Does anyone can suggest is there anyway he can become permanent resident in case if he gets admission in school in Grad 5 ? and how long it takes him to apply for PR ?

There is no immediate way for him to become a permanent resident on his own since he is a child. Getting admission in school in Grade 5 will certainly not allow him to apply for PR.

If his parents qualify to apply for PR, then they can include him as a dependent and he will get PR along with them. That's really the only option until he's an adult and can qualify to apply for PR independently.

There is no way for the child to gain PR on his own. His parents would have to file for PR and he would be included in the application. You can have them check here to see if they qualify: http://www.cic.gc.ca/english/immigrate/eligibility.asp

I wasn't making a blanket statement. I was specifically targetting OP's situation only since he was asking the question. So I relayed a response specifically to him. I don't make statements I know nothing about. If I don't know the answer, I don't make one up.

I don't believe you have any choice but to help your nephew get a study visa and swallow the international tuition cost of over 11 grand a year for his schooling. He cannot get PR on his own but only through his parents if they choose to apply for PR and qualify.

You also need to look at the long term picture.. This 7 years will only get him to the end of High School.
So, after spending all those years in Canada, growing up in a completely different culture, you are going to send him back to India? (Or, perhaps you think he can gain PR at the end of High School somehow?).

So, you then are possibly stuck with him having to be sponsored as a student for further education (another 3 years maybe?).

Then he has to go home or perhaps get a PGWP? and then, finally, he *might* be able to get PR through CEC?

At each step, he could be refused a visa for the next step and then it's "bye bye".
