Hey guys,

my bf and I are gonna apply for my PR through the family class from within Canada. However we have to wait until May 1st to send our application, since we started living together May 1st,2012 and we have to show proof of a "1 year living together as common law relationship."
Anyways Im really,really concerned and worried right now : My working holiday visa is gonna expire May 1st and I applied for a new visa (a plain tourist visa) on March 28th. However because of easter my application even send with xpress got there on April 2nd. The internet says youre supposed to send it at least 30 days before your current visa expires so that they have enough time to process.
Im so incredebly scared I wont get a tourist visa and would have to leave Canada(the flight ticket is gonna cost me a fortune if I buy it one day before the flight!!!).
Even if it got there on time, when I applied for my new visa I asked for an extension so we could send in my PR application through the family class. Now Im scared theyre just not gonna give me a new one as they think I already spend enough time here or whatsoever.
Has anyone ever made any experience with that?
Plllleaasse I need to hear opinions. I am so so scared! Everything is going just well here,we´re about to move back to NS to our farm, I´m about to get my dream horse ,everything is just awesome. Please dont let it be over.

I don't know where you're from, so it's a bit difficult to make assumptions.
but - the deadline for 30 days is more an indication than a strict deadline - so if you sent it before your current visa expires, then you're good.

So if I understand well: you have a working holidays visa until the 1st may and you have already sent the application to change your status to a visitor one? if that's correct, then no need to worry for now - even if you don't have the answer before the 1st of May, you have "implied status" - which means that until you get the answer about your tourist visa, you are legally allowed to stay in Canada until you hear back about the tourist visa. You should stop working when your work/holiday visa expires, but apart from that, it should be good.

If you have explained in your application that you are in the process of applying for PR, and you have shown proof of funds, and you are from a visa-exempt country ( I don't know, but I assume, as most work holidays visa are), then there is a good chance that your visa will be granted. You can also extend it (if you get 6 months for example) as long as you do it before the end of the visa.

So - wait until you hear back from CIC, but from the situation you describe, I don't see any reason to be alarmed. Of course - I'm not CIC and I haven't seen your application but there are plenty of people in a similar situation.

Also - not sure if you are aware: you don't have to apply inland because you're living in Canada. You can apply outland, and still stay in Canada. Outland is faster most of the time, and you still have the possibility to go in and out of Canada if you want to. With an inland application, you have to stay in Canada for the duration of the application, no matter what.

Try not to worry to death. For my first extension, I applied less than 30 days out and I got my extension approved. They won't deny just because of that! :)

I should also mention that I am from Germany.

To be honest, Im really close to breaking down in tears because when I google this questions it says that most of the time(or rather Its almost for certain) you get refused because you dont show proof that youre gonna leave Canada once your visa expires.
I dont have any proof that Ill leave as thats not want I inted to do(of course if my application gets refused and I have to leave the country I´ll definitely do so).
I showed them my private health insurance and our bank statements showing that I got enough money to provide for myself. The bank statement also shows that I have a shared bank account with my bf.

Now Im even more scared because with all those facts they will definitely think that Im not intending to leave Canada soon. (and I´m not, as were gonna apply for my PR from withing Canada).




What are your thoughts on this?

Yeap I know, but I wanna stay in Canada anyways (its already my "home", and I wanna get a work permit for the "other half "of the waiting time, and I already got a job offer for this time etc.

In Canada you're allowed what is called "dual intent" - applying for a visa where you should normally leave at the end (tourist) and for a PR - where you don't want to go anywhere. it's allowed, and honestly, if you have proofs that you can support yourself, and you're from Germany, there are few chances that you will get denied.
So - don't worry too much about it. If you get denied, you can always find a solution and worry about it at that point. For now - just enjoy!

Did you say you were waiting to qualify for common law? I told CIC that (gutsy move on my part) and it was all good.

Don't worry. Being visa exempt you should be fine.

I sent a letter to CIC explaining the circumstances together with my application for the new visa.

"[...]I entered Canada on May 1st, 2012 with a working holiday visa, which will expire on May 1st, 2013. I would like to stay in Canada as a visitor ,to stay with my boyfriend, Canadian citizen by birth, until we send out our application through the family class (he is going to sponsor me as my common law partner.) However we are not in a common law relationship as of yet as we started living together May 1st,2012 and to be in genuine relationship we have to show proof of us living together in a common law relationship for at least a year. This condition will be fulfilled on May 1st, 2013 and we will be sending my application for PR out as soon as I get the results of my medical examination.
I have enough money to provide for myself , my german family and my Canadian future parents in law are willing to support me financially in an emergency. I am also covered under a private health insurance in Canada.

I´ll keep this thread updated and will tell you guys about CIC decision just in case other people are gonna go through this in the future :)
