Since you surrendered your own genuine passport to an agent you are responsible for the information and documents provided to the consulate as if you submitted the application yourself. If you were rejected because of fraud or misrepresentation you will have to wait out 5 years even if the agent made the mistake.

If you wish to apply again, it is in your own best interest to use the previous passport and own up to whatever mistakes your agent has already made on your behalf. If you insist on getting a new passport and using the above story you'll be complicating things further, you'll be called in for an interview and questioned about the integrity of your story such as why you haven't filed a police report things that basically show you are not being credible and the officers will be writing your answers in a report that will stay on your immigration record, and then ultimately refuse your application if you were already inadmissible for misrepresentation.

Too complicated.

Just report your agent.
Try to find a way to contact your embassy/consulate or something to find out.
