Skilled Worker or Common Law Sponsorship?

We are debating whether to apply for a PR as common law or as skilled worker (German with 73points).
Which would be more likely to be approved?
Is it possible to apply for the other if one as been rejected?

We would very much appreciate all your inputs and suggestions.

Spousal common/law. Sure you can apply in the other category, but if you apply in skilled and are refused, you spousal will be looked a very closely.
