Skilled Worker-Canada immigration refusal

I have applied for Immigration and got positive approval from Canadian Government Nova Scotia office and they offer me an option to apply for Canadian PR in New Delhi Office.I submitted my documents on 1st june 2010. On 25 Jan. 2011 i got refusal letter.



In my rejection letter they have mentioned that I have not completed 12 months full time work experience as a Chemical Processing Supervisor in the last 10 years. However, I have provided all the supporting documents to proof my job description and details as a Senior Quality Control Officer (Supervisory grade – S2) in Quality Control Department – Ranbaxy Chemical Manufacturing Unit, Toansa Plant, Nawanshahar, Punjab – INDIA.



I have more than 5 years full time work experience at supervisory level and matching 99% job duties as a Chemical Processing Supervisor.



I have provided all my genuine documents and information to support my visa application. As per knowledge my application is complete except my Work Experience Letter. I have explained my job duties on Affidavit as per embassy document check list

Moreover all my colleagues having same documentation ,qualification and experience got positive result from embassy.

I am from middle class family, which cannot pay the fees of lawyer to appeal in federal court of canada.

please give me suggestion, What i can do ?

Regrettably affidavits of your job duties are not accepted any more by CIC. In short, they need proof with supporting documents from your actual employer that you performed the duties, and will not just take your word for it with an affidavit.

So although the duties you have claimed match the NOC description, from their point of view, they have no proof of this.

Why are you unable to get a work experience letter from your employer? My best advice is to chase your employer very quickly and get this letter, then urgently contact the visa office with the letter asking them to reconsider.

If your NOC is still on the current in-demand list it may be quicker to simply re-apply, this time with the work experience letter, since post-June-2010 applications are being processed on a priority at the moment, it seems.

I wish you the best of luck, but I do not believe you will succeed without getting a work experience letter from your employers or former employers.

Can u describe in detail what do u require I mean what help? May be I can help u as I also did each and everything myself and my wife. I didnt use any representative. Lawyer was costing me 11000 saudi riyal, which was too much for me. Bcoz applying for immigration alrdy has its own expenses. Notarizing the docs, sending them to Pakistan and Embassies. So pls do let me know ur prblm so we can help.

Ranbaxy is a big company and the HR won't entertain this request until he resigns. Plus it will really affect his present career if he asks for letter and he'll be in soup if he gets rejected.

I am really worried now.I too have given an affidavit for job duties. Additionally I have given my joining letter, apprisal letters, etc(on company letterhead). I have also given visiting cards of my bosses.
I hope I am not rejected.

What lot of people don't understand is that it is really really difficult to get letter of experience form a big company(I know I work in one). The attiration is very high and bosses don't want you to leave. So if I ask for such letter there will be eyebrows raised and it will affect my apprisal and overall reputation in the firm(people thinking that he/she's gonna leave, but in reality it is a long long wait).

Dear Gurpreet,
First of all, I am sorry to hear that you got rejected. However, can u specify whether u provided any supporting documents for ur experience in lieu of reference letter such as Payslips (old and current), promotion letters if any, training certificates relevant to your profession (if available), visiting cards, awards etc. This is because one person on this site got visa some months back without reference letter. However he provided many other supporting docs such as those above.
Also in your affidavit, did any of your colleagues etc. vouch for ur work ex. giving their designations etc. or did u sign it alone? There is a faint chance of re-consideration of ur case as u seem to have genuine experience, but u have to act quickly, as time has already elapsed.
