Hi Guys: I need advise on this matter please...
* My father-in-law will be applying for canadian immigration under skilled class worker. He will also apply for his kids who are un-married. He has a daughter with 3 kids (10 Yrs, 4 yrs and new born).. She is separated with her husband. Can she be included in my father-in-law's immigration application like other unmarried kids?

What family members may come with me to Canada when I immigrate?

The family members that can come with you to Canada when you become a permanent resident include:

* your spouse or common-law partner
* your dependent child or your spouse or common-law partner’s dependent child and
* a dependent child of a dependent child.

Your parents, grandparents and other family members are not eligible to come to Canada with you. However, you can apply to sponsor them to come to Canada after you immigrate here.

I am already in Canada ... My in-laws are thinking to apply for immigration. My father in law will be the principal applicant...I have already surfed the cic website..nothing reg this is there....

The question is if his oldest daughter who has 3 kids is also considered his dependant child. This is immigrations definition of a dependent child:

A son or daughter is dependent when the child:

is under the age of 22 and does not have a spouse or common-law partner
is a full-time student and is substantially dependent on a parent for financial support since before the age of 22, or since becoming a spouse or common-law partner (if this happened before age 22) or
is financially dependent on a parent since before the age of 22 because of a disability.


So if his daughter is older than 22 which I assume she is because she has a 10 yr. old child, she is not considered a dependent child unless she is disabled or if she is a full time student and has been a full time student since before age 22 and has been financially dependent on her parents the whole time.

If she is not considered a dependant child, then her father can not bring her children either on his application but she could apply on her own for herself and her children.
