I am an international student in Canada. I have renewed my study permit in April however I haven’t renewed my SIN number yet. SIN is expiring on July 14. Here’s the tricky part, I have been working with a software company remotely part time. I am still working with them, however, I am in India right now until September and I cannot renew my SIN until Im back in Canada(ie September). Will it be a problem if I continue working and renew my SIN when im back. Afterall, I have a valid study permit which permits me to work.

You will need a valid SIN to work. Most likely your employer will nor let you work with a expired SIN.

If my employer doesn’t care and I continue working, and then when Im back in September, I can renew my SIN. Will this affect my PGWP application?
Thanks

This can affect your PGWP application, PR application and anything you choose to do with IRCC. What you want to do is illegal, not allowed, period.

Obviously you don’t care as well . If the SIN is not valid , and your employer files any paperwork with either the CRA or the ESDC it’ll be flagged as work not authorized, and that information is sent to the IRCC , who are the people that authorize the PGWP
But do what you want ....

It is not illegal and will not affect a PGWP/PR app. Why would you think it would? OP isn't even working in Canada right now, so technically, not even authorization to work in Canada is required. OP can just renew the SIN when back in Canada.

It won't be flagged as unauthorized because it isn't. OP has the legal right to work in Canada. Even if they didn't, they aren't even IN Canada right now, so still a moot point. Also, CRA won't know or care as long as taxes are being paid properly and they certainly will NOT report anything to IRCC.

No problem. Just renew it when you get back. Many people forget to renew their SINs when they extend or change their status and end up working in Canada on expired SINs for months or even years.

OP has been working with the company remotely while in Canada. If he was working in Canada then he must have given the SIN number.

Currently OP is in home country while still working the same part time job he was remotely working in Canada, even though he has gone to his home country.

Therefore his employer will still be filing records as if he is working from Canada. Therefore a valid SIN will be required to continue working legally.

OP has the right to work in Canada, so even if s/he was actually here in Canada, there is no illegal work happening. Search the forums. There are people who worked for years on expired SINs because both they and their companies dropped the ball. IRCC doesn't care because they had the legal right to work. CRA doesn't care because they paid their taxes. No one cares because it is simply an admin issue in getting the SIN renewed.

You are unnecessarily trying to scare this person into thinking they are doing something illegal when they aren't.

I don't want to be responsible when people get caught because I told something was alright to do.

There are plenty of things done in this forum that fall into the grey area or are illegal.

If you are allowed to work because of your study permit then the idea of a SIN number is completely lost. The fact is that a valid SIN number is required and it is your duty to update the expiry date. It is also the employers job to ensure you do so.

https://www.canada.ca/en/employment-social-development/programs/ei/ei-list/ei-employers-sin.html

I am giving my advice with an abundance of caution in mind. I personally feel its not worth risking 1 months pay over any future complications.

Several people work without SIN, work more than 20 hours and never get caught since they slip the net.

You are free to give what advice you want, he is free to follow what advice he wants. We are all adults here.

The SIN is to remit taxes. That is still happening even when it is expired. It is not illegal.

Are you in Canada ?

do you have practical knowledge on this ?

canuck_in_uk is saying the right thing .
I totally agree with him based on practical experience as well as the fact CRA and CIC are two big organizations working totally independently (unless someone reports only then they share their informations.)
