Should I submit a H&C application? Kindly advise

So out of interest how old is this child, school age ? I may have missed it but what is your work skill ? Have you identified a NOC that matches to your job duties and is it classified as 0,A or B? Did you work with a PGWP post your study permit and if so at what job was that a skilled position and for how long ?Does your wife have work experience and qualifications ? Are you in a financially secure position ? You mentioned your IELTS score but what is your CRS score given there are options other than getting the current 460 plus for EE such as PNP or AIPP ?

A lot of questions but all relevant to any immigration application whether standard or H&C.

Agree with Vensak be very cautious about what an agent might say as they are in business to make money whether you succeed or fail there are no refunds and an agent cannot influence an outcome. Your choice of course but at least exhaust all other options first.

The challenge with H&C is that , and not saying this is your case, hundreds of mothers try to come to Canada to give birth for the child to gain citizenship then try to use that as a lever to try and get their own PR status. The majority are disappointed but still they come.

I just finished speaking with an immigration consultant. She said I could submit a H&C application on the grounds that my child is Canadian and needs access to good education, healthcare and other social amenities which are currently not available in my country. She also said that since I have Canadian education and my several attempt to get PR via express entry she can prove that I have the desire to come and settle my family in and not be a burden to the system.

Do you think these points are good enough to get the H&C approved?
I assume the immigration consultant told you that you must be physically in Canada to apply through H&C. So the first required step would be to come here on a tourist visa. You cannot apply from outside of Canada.

H&C approval rates are low and your case isn't very strong.

Expect to wait over a year after you submit the H&C application before you know if you have first stage approval. You will not be able to work during this time in Canada or have access to free health care. So you'll need to consider how you will survive in Canada for a year plus without having the ability to work - you will need to live off your savings during this time.

If you had the money to pay for a hospital birth and a year of education in Canada you should be in a position to provide good schooling for your child in Nigeria. It is unlikely that you will get another TRV because you gave birth in Canada on your last TRV and I assume you weren’t forthcoming with your intentions and only indicated you intended to visit family. Your best option would be to qualify for PR via one of the economic streams.
