Should I apply for FSW after rejection on student visa this year

Hi,
Quick background profile
2007: Applied for FSW . Fast forward to 2012 - Offer to get application fee back due to 300.000 backlog.
2014: Applied for student visa after a long long process of admission at RRC Winnipeg (trust me, not fun to produce portfolios and all). University accepted but visa got rejected as my ties to home country (Pakistan) not strong enough as I am currently an immigrant in EU.
2014: Still wanting to move to Canada as my current immigration expires in 2015.

Now my question is should I take a risk to apply for FSW after rejection on student visa this year? I qualify for one of the NOC with 2 years of work experience to back it up. Got sufficient funds in my own account. Proper age (31). Married. Have a kid as well. I know I'll have to take IELTS to prove language (dont need it as I have US degree but if they require so be it). I might also need to get my education assessed as well (its EU based Masters).

There is nothing stopping you from applying for FSW if you qualify. Yes - you'll need to take IELTS (general). Yes - you'll need to have your education assessed.

Thanks scylla but would they not get edgy if they see me applying for FSW while in the same year (less than 2 months ago) I have been rejected for a student visa. It bothers me a lot that this CIC officers are a bunch of heartless people who see us as an application and numbers.

No - they won't get edgy. I'm not sure why you would think that. The student visa refusal will have no impact on the immigration application.

Your student visa was rejected because of your ties to Pakistan. The FSW immigrant visa has no such requirement--so if you qualify, go ahead and apply
