should Canadian spouse to be included in application ?

Hi

My spouse is Canadian citizen so obviously he doesn't need to immigrate. Now I am filing for express entry, so do I have to include my spouse in the application.

Please suggest

Hi, there. When you create an express entry profile. It will ask you if you have a relative in Canada and how are you related to him/her. so you will choose spouse. He doesn't need to have a medical exam etc but you will still need to enter all your spouse's info that is being asked...Mine is the same, I am married to a Canadian citizen and now I recently got an ITA

My wife is Canadian Citizen too, and I entered basic details about my Marital Status etc. But I didn't include my wife in EE application. Please look at the answer that I filled

QUE : Marital status?
ANS : Married

QUE : Is your spouse/common-law partner included in this application?
My ANS : NO

QUE : Do you have a relative in Canada who is 18 years of age or older and is a Canadian Citizen or Permanent Resident living in Canada?
My ANS : SPOUSE/ PARTNER and living in ONTARIO

So I didn't include my wife in EE application, but for example if I add her in EE application, then I need to tell everything about her Education/Canadian Experience/ Language Test.(technically spouse doesn't need to prove any kind of language test as he/she already a PR or Canadian Citizen ). Hence, any one please suggest, is it mandatory to include your Spouse/Common-Law partner in EE application even if he/she already a PR or Canadian Citizen?

yup that is correct, and I didn't include my spouse's work history and he doesn't need any language test, i believe, as you will not get any points with that anyway since he/she is a Canadian citizen.

I am in the same boat - my common-law partner is a Canadian citizen already.

On the Express Entry Application (IE: what gets us entered into the pool) I chose:
-Marital Status -> Common-Law
-Number of Family Members -> 2 (her and I)
-Relatives in Canada -> Yes, Spouse/Partner
-Is your spouse/common-law partner included in this application? -> No

As a result I did not have to submit any language scores, education, etc. for her and my scores were applied as an individual. Makes sense, as others have pointed out.

Now I received an ITA and on the Permanent Residency Application and there is a section specifically for my spouse.

Interestingly, the first question in her "Personal Details" section is: "Will this person accompany 'the primary applicant' to Canada". It is already answered as "No" and to change it, one would need to modify family information as the help window says. Below the answer I am allowed to explain why she will not accompany me to Canada. I typed that it was because she is already a Citizen living in Canada. It is an oddly phrased question so I'm curious if anyone has a different take on it.

Anyhow, as part of her section of the application we must (just like the primary applicant) submit information on her immediate family, provide 10 years of addresses, 10 years of travel outside the home country, 10 years of personal activities, etc. This part is tedious but it gets worse.

Once you get past the survey part of the application you move onto the part of the application where you can submit all of your supporting documents. This is where things get weird for those of us with Canadian spouses.

My spouse again has her own section where it asks for her:
-Police Certificates
-Proof of Medical Exam
-Digital Photo
-Passport/Travel Documents

The police certificate and medical exam are not exactly easy or cheap. Is it right that we have to submit these for someone who is a Canadian citizen? :eek:

arleneramiro - you mentioned that the spouse wouldn't need a medical exam. Where did you get that information?

Hi motorhed, we asked our company's immigration lawyer and they said he doesn't need to have any medical...when my colleague, whose spouse is her common law, she had all of us scheduled for a medical exam but the doctor said they wouldn't even examine the one who is Canadian citizen. I noticed the express entry still needs some tweaking, you can also ask some CIC agents but I am pretty sure, this will be brought up soon. What is the logic behind a Canadian citizen getting checked when the purpose of the applicant is to apply for PR? the Canadian spouse doesn't need to immigrate to his own country...

Thank you for the background arleneramiro! I will try to contact a CIC agent to confirm that citizens do not need medical and weigh in on the police certificates as well. I agree there are still bugs that need worked out of the Express Entry GUI.

@motorhed, the last time my colleague asked for this was when we received our ITA and filling out the questions online, then recently we encountered the same fate as yours, with regard to uploading the spouse's medical and police check etc. The problem will be the system, it will not allow you to continue unless every "required" documents has been updated. So, this will be our next question with our company's lawyer, how to bypass the spouse's "upload" stuff etc so we can continue in submitting the application. I haven't talked to a CIC agent about this so if you talk to them, maybe please share what they say on this thread...i will also share what the lawyer will be telling us soon to help us all... ;D

I called the CIC call centre today and the agent confirmed that Canadian citizen spouses DO NOT need to have medical or police certificates.

The agent said this is because:
a) they are not included in our application and
b) they are Canadian citizens

If they were citizens of another country they DO need to upload those documents which likely shows where the flaw is in the computer system. A failure to look at our specific scenario and remove certain documents from being requested.

I plan to just upload a note about her citizenship and the discussion with the agent to the medical and police sections in order to "bypass" the system and allow me to continue the application.

way to go! yes, i also talked to a CIC agent and he told me that the system doesn't recognize the spouse being Canadian citizen and he just advised me to upload an explanation saying that he is a Canadian citizen, so i guess this closes the loop on Canadian spouse... good luck to all of us!

Did you run into any problems with CIC with your eAPR when you uploaded this statement about Canadian spouse? Seems like a reasonable thing to do but CIC wouldn't confirm that it was ok to do this when I called this morning. Thanks for any help.
