Dear all. A friend of mine from FSW has received EOI recently, however, his preference is to immigrate to another province. I just wanted to know what exactly is the rule for moving to a province other than the province from which nomination is received.

I got to know from somewhere that once provincial nomination is received and the candidate gets additional 600 points in the EE profile, the candidate is free to move anywhere after the application is approved; only landing has to be done in the nominating province. Whereas in general i have heard that there is a mandatory period (3 yrs probably) which has to be spent in the nominating province before moving to another province.

Could someone please shed light on this and give more clarity.

Examination at the Port of Entry
  • Individuals who indicate that they intend to proceed to and reside in the province/territory of nomination, and who meet the other requirements of the legislation, should be processed for PR status.
  • Individuals who indicate that they never intended, or no longer intend, to reside in the nominating province/territory may be denied PR status at the POE and may have an A44(1) report written against them.
  • In the case of individuals who indicate at the POE that they no longer intend to reside in the nominating province or territory, the A44(1) report may be written for non-compliance with paragraph R87(2)(b) pursuant to section A41.
  • An additional allegation of misrepresentation, pursuant to paragraph A40(1)(a) of the IRPA for R87(2)(b), may be included in the A44(1) report for those individuals who indicate that they never intended to reside in the nominating province or territory, if supported by the information obtained through examination at the POE.

Thanks. From this it's clear that entry has to be made in the nominating province.

What is the requirement going forward? For how long does the person need to stay in that province or is he free to move anywhere after PR is received?
