SETTLEMENT IN CANADA 3.5 YEARS AFTER PR GRANTED - ANY PROBLEMS???

Hi Guys,

I was granted PR status in March 2013, stayed for a couple of weeks and then left the country.

I am aware that I am now over the 3 years mark for being away from Canada.

Can I re-enter Canada, stay for 2+ years, and then apply to renew my PR card with no dramas???

I understand that this will result in me having to stay in Canada for a period of time with an expired PR card. Is this a problem?

Yes you can, if you can enter Canada without any border security people noticing this fact.

When you enter Canada (by land or air), if CBSA officer notices you do not meet residecny obligation, they may report you which basically begins process to revoke your PR status. You can enter Canada to appeal this. If you lose your appeal by not having any H&C grounds, then your PR will be gone.

Not really, as long as you've already gotten your SIN, drivers license, etc before it expires.

Hi! I have some questions and need advices coming from you. We (my husband, me & my son) were Immigrant landed in Canada last November 2012, holding a Canadian Permanent Resident Card and after 2 months we went back home to our country Philippines for a reason that my husband need to go back to his work in Saudi Arabia to finished his contract. Still we are in the Philippines and we are planning to move back in Canada before our Permanent Residency expire. Do we chance and possibility to go back and stay permanently in Canada. What documents we need to provide in order for us to go back at the earliest time.

Hope you can help and advise us regarding this matter. I'll be waiting for your prompt reply.

Since you will not be able to meet your PR RO when you try to enter, there is a chance that CBSA will notice this and report you to IRCC. You may get lucky and the CBSA officer might simply let you in without any questions or even if he/she finds out you don't meet your RO, he'll just let you in with a warning but not report you to IRCC. No one call tell you what the chances are since there are way too many variables. The one thing you have in your favor is you will try to return before your PR card expires. That will help.

A PR card usually expires around 5 years from the time it was issued. If you landed in November 2012, it likely expires around November 2017. The expiry date should be on your PR card.

Is it possible if we are moving back to Canada, me and my husband will look for a job online for a direct hiring so that we have a sure job when we enter to Canada showing our PR card.

Sure you can try that. However it won't have any bearing on if CBSA reports you. You don't meet the residency obligation, so if you're reported there's a good chance you will lose PR status. It sounds like the only reason you stayed outside Canada was for employment, which is usually not suitable for a H&C reason.

Even if you make it into Canada without being reported, you'll all need to stay inside Canada for 2 years without leaving even once, before you can apply to renew your PR cards.

our PR card expire on January 2018, we landed Canada on Nov 2012. we stayed only for 2 months and went back to our country home. we are planning to go back to canada, is it easy or possible for us going back to canada. Can we enter to Canadian airport immigration. they will not question or hold us for not completing the days of residency in canada. We decided to go back to Canada before our PR expires. As I mentioned earlier: No one call tell you what the chances are since there are way too many variables

This still holds true. A lot of it is simply luck and comes down to which CBSA officer you get and if he is a good mood or not. All I can say is that your odds are much better if you try to come back before your PR card expires, which you plan on doing. After that, who knows?
