Hi,

I never thought I will be asking these questions but with a heavy heart I am here seeking some information. I am on Closed work permit with my wife on Open Spousal work permit in Nova Scotia. With problems between us, I left the apartment for which the lease is in my name. I tried to talk to her to take over the lease but she has refused. I am not sure what my options are if I plan to surrender the lease.

Though we are parting ways, don't want it to get ugly. Do I have financial implications or committments as she is on Open Spousal work permit and earning well. It is difficult for me to pay rental for two apartments !!

Please advise what options I have and how can I proceed.

I don't think you can just "surrender" a lease in Nova Scotia. I believe you are responsible for paying the lease until it ends. If you and your wife are no longer going to be living there - you should find someone to sublease it for you for whatever time is still left on the lease.

I have left the place... my wife is still there and refuses to leave and contract with the landlord is in my name. I am on month to month so i can give my landlord a months notice.

My concern is.. as my wife came on Open spousal work permit (which i believe is dependent visa) .... will I be held responsible for her well being and her stay and expenses?

You can give your landlord one month written notice(make sure you sign and date it). It may be late to give notice now for July 31st(unless your landlord is very nice) but you can give notice for August 31st by 12noon. It may be wise to also inform the landlord you no longer reside at the premises(for personal reasons) but your wife does and you will inform her of this notice.

Inform your wife(use email, so you have a paper trail)...this way she has some time to look for a place of her own. If she plans to continue residing there, she needs to make arrangements with the landlord and sign a lease in her own name. If she doesn't leave by then, the landlord can serve an eviction notice and that will not look good when she tries to get another apartment.

Lastly, she got an open work permit based on your closed work permit. If you are not together, perhaps CIC needs to know? Note that they could cancel her work permit. If they do, you would have to pay her spousal support until she has a job or re-marries. You may want to speak to an immigration lawyer first to explore your options.
