Seniors plz suggest: Restoration period: Can I land in Canada ??

My work permit extension was rejected. I am within the 90 day restoration period.I havent yet restored my status .I have received my passport from Detroit and want to complete landing procedure.
How do I go about?? Can I leave Canada and cross the US border and come back to Canada as I have US visa ??? Or I can even go to India and come back and complete landing procedure ??
Or do I have to restore my status in Canada as a visitor and only then am I allowed to leave and re-enter Canada (from US or India) and complete landing procedure ??

Hey Dude, you didnt apply for visitor visa before expire? i am kinda in a same boat as you are. currently i am in implied status for visitor permit..
i think you can apply for restoration which cost you 150dollars?
i am hoping as long as you are able to stay in canada legally, there is no problem.
as long as we are clean, legal, and blameless, CIC dont kick us out.
somebody give us a advice please.

I had applied for renewal of my work permit before the expiry of my work permit. I just recently received a letter from CIC that my application for work permit is rejected and have to resotre my status. But I already posted my passport and fees to Detroit. before the receival of work permit rejection letter .

even if i apply for restoration it takes 40 days to get a reply. I will receive my passport and COPR from Detroit in a week now.So do I wait for 1 month just to get my restoration status and then do the landing procedure ???

I tried calling CIC but the line was always busy and cldnt enquire.

I know you will be getting COPR visa pretty soon. but when you cross the border, are you hoping immigration officer let you out/in Canada without any problem? you dont need a visa for US? if you are lucky, they will let you out i guess. i dont know.
but somehow, if you have something to show immigration officer to your effort. you know what i mean.
my work permit expired on July 9th and i want to stay in Canada legally. you know what though, immigration officers are legalists. Law is their boss. as long as we follow the law/rule, we dont have any problem at all. just follow your step. maybe you dont need to pay 150 bucks for restoration or you can cross the border without any problem or get penalty...only God know man. anyway, good luck and keep me update your crossing to US.

I did my medicals on 15 April 2012. This thing doesnt make sense to me. According to the letter I have to restore my staus or leave Canada.Eventually I have to leave Canada and am returning because my application has been approved for PR . My husband is in India and will be coming to Canada first time as being a dependent spouse he too was granted PR with my CEC application.
Just to inform I do have US visa .

Why is it that I have to book an appointment with CIC ?? Didnt get that part ??

You can land when you return to Canada or you can do it at a local CIC office by booking an appointment. So it's your choice. I hope this is clear enough.

I think there is confusion here because you are combining two independent events: your work permit extension and your PR application.

CIC's answer with respect to your work permit extension (and the "restoration of status") is ignorant of the fact that you have been granted permanent resident status (although being granted permanent residency does make the rejection of your work permit moot.) What it DOES mean is that you can no longer legally work in Canada until you either get your work permit back OR you become a permanent resident - personally, I think you'd be crazy to bother with a work permit if you've got a COPR.

If you get your passport back, you can simply go to the border (you can do this WITHOUT a US Visa - you would just be refused and sent back to Canada, but this is fairly common). I know at Peace Arch, you can actually TURN AROUND before you get to the US booths (you are technically inside the US) and that puts you into the inbound Canadian traffic flow, so you pull up to the booth, advise them you wish to complete your landing as a permanent resident, and they send you inside to do the paperwork.

You have a COPR. You won't need a counterfoil to get to the POE at the US/Canadian border (this is why visa-exempt passport holders don't even send in their passport anymore - all they technically need is the COPR.) If you fly back to India, however, you would need a TRV (otherwise the airlines won't let you fly BACK to Canada) unless there is a counterfoil in your passport (in which case that functions as your TRV.)

The alternative is that you can land inland (you call CIC, make an appointment at a local office and then land there.) However, you cannot legally work until you either restore your work permit OR you land, so unless you are independently wealthy, it's probably wisest to just flag pole at the US border (where you just turn around and re-enter Canada.) Then you'll be legally allowed to work again and your husband can join you as well when he is ready to land.

My PGWP expired March 17th, week before it expired, I applied for an extension without LMO, knowing it will get rejected, but it'll buy me a few weeks on implied status. Soon enough, I got the rejection, and I stopped working, and planned to apply for my restoration of status as a visitor within 90 days. That would have taken me to August 5th.

I got my PPR on June 22nd, and applied for my restoration of status as a visitor on June 26th ONLINE. I was told by CIC that it is ok, but i need to print out a confirmation that I applied, and also a copy of the receipt, incase I have to prove my legal status in the country. I did all that, and landed at the border with no problems. So don't worry, as long as you apply 90 days after your implied status expires, you are legally ok in Canada at the time of your landing.
