Dear Seniors ...

I have total work experience of more than 7 years in Exports and working in senior management for more than 2 years now .As per my evaluation NOC should have been (0601) .I was about to submit my EE profile yesterday but i received a reply to an email i had sent to hrsdc few days back .

They have given 6411 to me which falls under C category :'(...my responsibilities have remained more or less same but the team and decision making authorities etc have been added with experience which i didn't mention in that email. The mistake i did was i gave them same profile for all three jobs i have done so far.

Does it effect if i still use 0601 because i am sure that my responsibilities match a lot with it ( and get reference letters stating the responsibilities).Also i have worked in middle and senior management for more than 5 years now ...

Or should i resend the email saying evaluate all three jobs separately please by adding 2-3 duties i have not mentioned ..Like i am decision maker in the current job and i am handling a team which i never mentioned in my email to them or that i make strategic policies ..sales contracts etc with buyers. and ask them to give me new NOC. What if they still give me the same noc they already gave.I don't know what to do at this moment ?? I have already got my ECA done for spouse and myself ...Have given IELTS (CLB 9+)

I am copying my email to h ere for you to see .Please guide me as i am totally confused and very much afraid to do anything.The most silly mistake was i mentioned same job responsibilities for the Management Trainee period as well.Am i screwed now??



Here's my email

please help me out identifying correct NOC for the below mentioned profile.

I have 7 + years of work experience in the same profile and I am a BSc graduate and an MBA - International Business.

I have worked with three jobs but in the almost same profile.

- 1st Job was as a Management Trainee and later i was promoted to Asst Manager - Exports (1+ year)
- 2nd Job was as an Asst Manager - Exports (3+ years)
- 3rd Job which is my current job is as an AGM ( which is in Senior Management) - International Business ( 2 + yrs until now).

PROFILE :-
Business Development of xxxxxxxxxx Products across International Markets.
Business generation from existing clients (Importers, Distributors & Agents).
Submitting offers to importers /re sellers/commissions agents, discuss/negotiate working terms, follow ups & then closing
the deal.
Appointing new distributors & agents for private as well as branded products in the assigned territory.
Coordination with Logistics, Purchase & factory for timely dispatches.
Arranging Pre-Shipment Inspection of cargo, if needed.
Making Marketing Strategies, Promotional Schemes & Advertising Budgets as per market requirements.
Organizing International Food Fairs and representing on company’s behalf.
Traveling to assigned countries for business development, relationship management and promotional activities.
Costing & analysis of various products as per requirement.
Generating Proforma Invoice, Shipment Orders, Shipping Instructions as per buyer’s contract or Letter of Credit
Making Shipment Schedules and then following up with factory until dispatch
Managing overall Marketing & Logistics aspects of International Operations.
Generating Annual Sales of INR 50 million from the assigned regions.
Travelled to xxxxxxxxxxxxxxxxxxxxxxxxxxxxxx for business purposes


the responsibilities which i missed mentioning were

-

Establish and implement effective sales strategies and marketing plans for buyers and retailers
- Managing a team of executives and assigning duties related to labelling , documentation and custom related procedures.
- Ensuring timely receivables and coordinating with banks.
- Negotiating Freight Contracts with shipping lines and Forwarders.
- Ensuring that the shipments are in compliance with the laws and regulations governing the export industry.


Please guide me

I will highly appreciate your feed backs...Do i need an immigration lawyer or an agent to handle this now??

Hi isha07,

To sum this up - you have 7 years of *foreign work experience in positions X,Y and Z. (*says FSW1 in your profile)
X and Y are NOC 6411 as per HRSDC recommendation which falls under C category therefore does not count.
For Z position you will include the new duties such as decision making, handling a team, making strategic policies, sales contracts with buyers etc. which, according to you, should make it NOC 0601, but if this is true you can only claim 2 years of experience which brings your CRS score down by 25 points (3 years bring you maximum CRS score).

Should the HRSDC again place your new duties with NOC 6411, I would still advise you to proceed with your EE profile submission using NOC 0601 if you are sure that responsibilities in the employment letter match that particular NOC. I invite seniors to comment, but in my opinion the NOC that HRSDC recommends is just that - a recommendation and not what CIC will necessarily consider. Additionally you can ask your employer to fine-tune your duties to more closely match the NOC you are aiming for.

First of all do not panic.

Secondly, proceed with your EE profile submission using NOC 0601 . The responsibilities on your roles & responsibility letter matters and that would be evaluated by CIC.

Make sure that you have proper roles & responsibility letter as per NOC 0601. All the Best.

Thank you so much for responding ...I registered yesterday (462 points) but my points will change to 457 in a month...so if the ITA comes for say 460+ ...should i accept or not??

Unquote
You are referring to your age. If you receive your ITA before your birthday (462 points) and submit application after your birthday, the points for your age automatically get locked at the value you had at the time of ITA.

No, ESDC does not send that to CIC/IRCC and even if they did, it is not binding in any way.

But you will be screwed if you do the same thing for your application.

By now, I hope you realize it will be 2-3 different NOCs, with 3 different job descriptions. Hopefully, you listed them as 3 different positions on your EOI profile. Your combined "profile" includes higher and lower level duties so it's not really possible to assign an NOC (at least in a way that would be different from what ESDC did...). You need a different job description for each position. (and btw the "management trainee" portion is not a problem, but if your responsibilities have remained the same through all positions, NOC 0601 would not be appropriate).

Start with your current position and prepare a job description for that position only, then we can help with the NOC. Doesn't need to be long or excessively detailed, just 5-8 bullet points.

You also need to provide more details about your business and what kinds of products are exported/imported, and who your customers are. This is because (for example) technical sales is considered skilled, where retail is not. If you don't provide enough detail to allow CIC to make the determination, they will evaluate your position at the lower level.

OK, this line makes no sense. Executives perform "labelling, documentation", etc.? No...

You don't, at least not because of ESDC's response.

However, given that the job description in the letter(s) of employment is the most important piece of information establishing your eligibility, and given how confused you seem to be about this, it might not hurt to obtain assistance in preparing job descriptions, selecting appropriate NOCs, and obtaining complete letters of employment.
