I am a Syrian guy who have a pending asylum case in the USA. I did my interview 2 years ago and still wating to hear. I was wondering if I can seek asylum in Canada with a pending asylum case in the USA. I have heard that many Syrians crossed the borders and seeked asylum in Canda due to Trump's executive orders. Can you please help me to find an answer? Because my lawyer told me it might take forever to hear your decision after all that.

If you try to legally cross the border, you should be expect to be turned back due to the above.

There are some who have illegally crossed the border and then claimed asylum. Hard to say if that would succeed for you since you don't meet any of the exceptions under the Safe Third Country Agreement.

It really depends what country you are from and what evidence you have to prove that you yourself have been personally persecuted.
 
What evidences are generally required?

Ideally you want to show evidence that names you and proves you've already had significant problem. So things like hospitalization records, police records, newspaper articles naming you, etc.

Safe third only applies to eligibility of making a claim. It doesn't have the same baring on the claim itself. If he crossed illegally, he would get a hearing and it would be assessed on its merits. Now if he crossed legally by land he would be ineligible and won't even get a hearing.

his mean that if you have legally entered Canada on a visit visa - you cant apply for asylum/refuge?
 
Is it only applicable coming from USA or coming from any other countries like India, Pakistan or Afghanistan?
I believe this is only if you have been rejected or even filed an asylum to any other countries as well like USA. Or is this applicable to normal people too who are travelling for the first time and have no asylum cases filed anywhere whatsoever.
 
Any country. However if you received refugee protection from a convention country then you would be ineligible.
 
Yes. Even coming from the USA to the land border, having a valid visa is a safe third exception.
