Hi

My question is can a person sponsor a second time. I was married before and sponsored, i stayed with my ex wife during the whole process in her country until we could come to Canada. We were married a total of 7 years 2 in her country and the rest in Canada. We were separated for a year in a half then divorced after about 4 and a half years in Canada. Now i have found my new life with a new lady and we have married, she is also from a different country but not the same as my ex. We have known each other for almost 2years and i have gone to see her too and we have documents such as some phone bills and chats and text, emails etc.. Will there be issues with this, should i hire a lawyer or can i attempt to do this on my own?

The most important thing to consider is whether your undertaking for your first sponsorship has expired. Spousal sponsorships are now 3 years - but they used to be 10 years. I don't know if the 10 years undertakings in effect at the time the law changed were reduced or not - someone else here should be able to say for sure. But if not, and if you are still within the original undertaking, you have to wait for that to expire before you're eligible to sponsor another spouse.

As far as your relationship timeline - you and your ex were together for a long time, the divorce happened quite some time ago, and your new relationship has been going on long enough that there shouldn't be huge concerns about the "genuine" nature of the relationship. When someone sponsors a partner, almost immediately separates after the PR is approved, and then the sponsor turns around and begins a new sponsorship fairly soon after they start to suspect MOC. Be sure you include quality evidence and proofs.

Yes. It's possible but is possible as well you will be transfered to a local office and be called for an interview. My husband sponsored his first wife. They got divorced more than 6 years ago. We started our application on 2009, just 1 year after the undertaking period expired and we were called for an interview.

The interview was today and we got AIP!!!

So the answer to your question is YES, as long as the 3 years undertaking period is over and you guys can prove that your relationship is genuine.

I believe it was 2002 when i was with my ex when we got married. I remember it being 3 years not 10 but would like to verify.

The sponsor is responsible for 10 years (3 years now) after the applicant "lands".

Baloo's right. The rules changed in June 2002. So the exact dates are going to be pretty key in this case...

Thank you everyone for the responses. I did some research on when the law changed from 10years to 3years, and if i am correct it was June 28, 2002. With my ex it was in july of 2002. If anyone can confirm i am right please do. Also i have a question about the checklist for question 6 Identity and civil status document asking for birth cert and such. Is this just for a sponsor person who has children etc?

I found a link with info about the change in the agreement but it wont let me post here, american law dot com
I have another questions concerning the pics for the spouse, should she/he sign one and put the date on the back or leave all blank? I know in the immigration manual it says to sign and date one pic and put birth date but not sure if they want family member only for that? And would it be a good ideal to label everything you can?

Follow the instructions EXACTLY. If they say label 1, then label 1.

They want her birth certificate and ID docs AND those of the children as well if there are any.
