Iam a Canadian getting married for the second time, first marriage lasted 11 years and separate for 7years total 18 years. Just got divorce 2014. My girlfriend is from india and she will be coming to Canada on a visitor/tourist visa, how do I get married in Canada and sponsor her as wife and have her live with me in Canada while waiting for PR? I also was on welfare two years ago not any more working full time, will that effect my application?

She will need her passport and birth certificate to get married in Canada.

If you want to ensure that she doesn't have to leave, you would sponsor her inland after getting married. You can find the forms here: http://www.cic.gc.ca/english/information/applications/spouse.asp

The processing time is something like 8 months to get first stage approval at which time she can apply for an open work permit and another 8 to get PR, give or take, they are averages so some applications are fast, some are slow. She should not leave Canada during the processing time because if she does, she risks losing her application. A requirement of inland is staying in Canada.

If she is not committed to staying in Canada for the duration, you can sponsor her outland which doesn't actually mean she must be outside Canada, she can be visiting you when you apply and leave later if she must and the application will continue to get processed. Whichever you pick, you have to make sure to apply to extend her visit visa before her status expires.

Thank you for your reply. Once I apply for her inland do they extend her visitor visa or do I do that first and then apply for inland. Also if she is in Canada, and they require a criminal or a marital check how would they do that or would they need to_One more thing, she is my cousin once removed. I have looked at the Canadian marriage laws and it is ok to be married. What I don't know is do I state that a on my marriage application? My thoughts are I should because that way there should not be any future problems in my sponsor application.

You apply for her sponsorship first. When you have some letter in your hand that your application was received, you can apply to extend her visitor status. However there is no reason to apply until it's about a month from expiring.

You can state when you write about how you met that she is your cousin. It would not be common in Canada to marry your cousin but in some countries, it is common.

Doses inland mean applying spouse sponsorship within Canada? Iam in India right now is there any thing I should or can do. She will find out next week about her visitor visa, her sister sponsored her from Canada. I have 1 1/2 months before Iam officially divorced. I just found out she doesn't have a birth certificate, asked why she said it was lost long time ago in her village. But she has valid passport, she traveled alot of countrys. She said it would very hard get a copy of her birth certificate. Please advise. Thank you.

Yes - inland means that both of you are in Canada when the sponsorship application is submitted.

The birth certificate is a required document. A valid passport is not a substitute for a birth certificate. She should really try to get a copy of her birth certificate even if it's difficult.

Is there any other substitute for birth certificate in India, her mother has passed away year and half ago her father left them when she was very little. She is 41 so I think it be hard to track her certificate. How about a affidavit of some kind?
