Hi all,

I am a first generation Canadian citizen born outside Canada (was born in 1984) to a nationalized Canadian father, I am currently living in Saudi Arabia and planning to stay here for the next years. My wife (Jordanian) is pregnant now. did not apply for family sponsorship to her.

My Question is: is there any way to apply for the Canadian citizenship to my coming baby (If he is born in Saudi Arabia) ??

Saudi Arabia is not giving the nationality by birth on the land and Jordan is not giving it to mother's children. So, is there any document I can request the Canadian embassy for to allow the baby to go to Canada? What can I do in this situation?

Please help...

Hi

It's unclear from your post whether you are a Canadian resident or actually a citizen. I'm going to assume you are a Canadian citizen.

Basically, there is no document you can apply for or immigration process that you can go through to apply for the baby's Canadian citizenship because of Bill C-37.

However, Canada is a signer of the UN Convention on the Reduction of Statelessness, which aims to prevent people from being stateless, as your baby would be. This gives you a way to fight for the baby's citizenship but it will be a very difficult battle. You will need government and legal assistance, so I suggest contacting your Canadian MP.

There have been 2 other babies in the same situation. See http://www.scholastic.ca/education/steppingupwithliteracyplace/standupforhumanrights/freedom/citizen1.htm and http://en.wikipedia.org/wiki/Stateless_person#Canada. The case of Chloe Goldring is precedent for you, as she was eventually given Canadian citizenship.

Another option that's probably less viable for you, depending on how far along the pregnancy is and jobs etc, would be to try to get to Canada to have the baby, as it would then automatically be Canadian. Drawbacks are that she would need a TRV to enter and she wouldn't be eligible for health coverage; you guys would have to pay out of pocket for the delivery, hence why I say it is probably a less viable option.

Good luck!
