HI everybody,

My husband is applying for PR Saskatchewan through WWICS under Arranged Employment. They are offering him employment in Saskatchewan but there is one condition that he should stay there for 2 years continuously. My question is that will he not be able to come back to India in any case before the completion of 2 years. Will he not be eligible for citizenship? Is it a compulsion to be present there physically for 2 year continuously.
Please anyone help.

In Canada, you get at least 2 weeks vacation per year and he may be able to get more during a time that the business is slow if there is such a time in his line of work. During his vacation, he can do whatever he wants.

If he is doing skilled work and I assume he is if he is getting sponsored, then you can also apply for an open work permit based on his permit in order to join him in Canada.

As for the 2 year contract, this is a requirement from the employer to sponsor him? If that is true, then that is not an agreement with immigration, it is an agreement with the employer. If he doesn't want to stay with that employer, from the point of view of immigration, he is free to leave the employer at any time after he gets his PR. His contract with the employer is a legal matter between him and the employer. He may have to pay a fine for breaking the contract but it would not affect his PR status or citizenship. If he finds himself in a situation that he wants to leave after getting his PR, he should speak to a lawyer to find out what his obligations are. I know of cases where an employer made illegal contracts with employees in order to fine them for leaving before their contract ended. The employees found out it was illegal and so they just ignored the employers request for money. The employer could not take them to court because he knew he would lose.

Can you please tell me what is the processing time for immigration to Saskatchewan. Also once PR is received can one move to other province.

If you qualify to apply under SINP, you would first have to wait for them to issue your nomination. This stage can take several months. You should contact SINP if you need a more exact timeline. After that, your file goes to your homeland and is processed there. The processing time as follows: http://www.cic.gc.ca/english/information/times/perm/provincial.asp for 80% of cases so the average is a bit faster that that. If you are legally living in Canada on a work permit or student visa, you can opt to be processed in Buffalo instead of your homeland. If you are legally living in a 3rd country, you can opt to be processed there instead of your homeland.

When you apply for SINP as well as any other PNP, you sign a statement saying you intent to settle in that province. Recently immigration has been cracking down on people who get their immigration through PNP but do not land in their PNP province and/or immigration believes have no intention to settle in their PNP province. They can put you under watch and notify SINP to check up on you. If they accuse you of having misrepresented yourself on your application, that is they believe you never had any intention of settling in SK and therefore lied on your application, they can revoke your PR. To avoid this, stay in SK for at least several months so that you could at least say that you did have the intention of settling there but that things did not work out for you and who knows, maybe things work out for you beautifully in SK and you will end up living there forever.

Is there anybody who can tell that after nomination from the Saskatchewan, visa authorities can deny the visa? If yes, then what are the grounds on which they may refuse visa.

If you are nominated by SK, you apply for PR to immigration Canada including your nomination. It will then be processed like any other PR application and could be refused if you are found to have a criminal background or dangerous contagious diseases or other major health problems that would be a burden on Canada health services. As spouse with a criminal background or spouse or child with major health problems can also get you denied.

But I'd think hard before breaking an employment contract. You need references for the next job, and breaking your word is not seen as a good sign. Besides, you've given your word.

Thanx leon for your prompt response. The things which you mentioned are the only basis on which visa may be refused or it can be on the mood of visa officer (as i have heard). We dont have any criminal record or any disastrous disease. :)

If you are nominated, no criminal background and no health problem, I do not think you can be refused even if the visa officer is in a bad mood.

Dont know guys what is there in our destiny. our file is ready for despatch to saskatchwan for nomination but now my consultant says that SINP authorities have changed some rules. :( :( Employers who have given offer letter have to get registered with SINP authorities. Again delay in sending my file. So very disappointed. :( :( :(

hello frds..

we have applied for sasketchewan pnp on 21july 11 and got the file no in july 11... were asked for additional documents on 11nov 11 which were send in nov itself... till now we havent received any news.. but the agent informed us dat we should expect our Nomination by May or June..... though we dont want to think negative but my husband is the main applicant and his brother is citizen of canada with govt job in alberta and is living in edmonton.. now the concern is that in this can the immigration officer refuse our case for nomination... but to be honest we have no intention of moving to edmonton ... pls help
