Actually this is my 3rd time to post a topic here, im staying here for 4 months and i left my partner in the philippines, im really worried out chance for common law sponsorship is so little, im planning to sponsor her next year, but i really dont know what do, im planning to apply a tourist visa dor her and we will get married here, is it possible? What are the other options that we have?

Start collecting your proof now. Anything you can do to show that you have combined your lives as a committed couple. Save proof of any monetary transactions, if you send your partner money. Save photos from any visits, receipts from gifts, logs of communication. If she is denied a visitor visa, because same-sex marriage is illegal in the Philippines (I believe?), you may stand a shot with a conjugal partner sponsorship (the most difficult class when sponsoring a romantic partner).

Keep in mind that, for a common-law sponsorship, you must be able to prove you have lived together for 12 continuous months. If you are married, you do not have to prove 12 continuous months of living together, but you still must have proof to satisfy CIC that you are a genuine couple in a real and ongoing relationship. Take photos and save other documents that can provide evidence of the time you spend together.

For photos we dont have a problem for that, yep i send gifts money to her as well, we've been together for 5 years, yeah your right, its not legal in the philippines, but if she will apply as tourist, how much money that she need? We used to have the same situation...the difference now is, my wife and I are already married we got married in Canada early this year during my 2 month visit to her. And now, we're on our 5th month for our spousal sponsorship...we've been apart since 2008 coz she had to leave for Canada and since then the relationship is thru long-distance...but we survived

Why not ask her to visit you in Canada and get married there for you to be able to sponsor her. If you are worried about the show money...your partner must prove strong ties here in the Philippines like bank account, stable job, properties, business and etc...Does she have any relatives in Canada that can make the invitation letter for her? If so, you can start preparing for all the docs needed...goodluck to you and your partner!

Please clarify your situation a bit more. You have been together for 5 years, but have you actually lived together for at least 12 consecutive months (with no breaks) in the Philippines or anywhere else during this 5 years?
Do you and your partner both currently live with your Aunt in the Philippines?

If this is the case then you would be officially common-law and can apply for sponsorship. If your partner can't get a TRV to visit Canada then you'll need to apply outland through Manila office. If you're a PR you must reside in Canada during the application processing, and if you're a citizen you can continue to live in Philippines.

To prove common-law you must prove that you have lived together for 12 continuous months. Photos won't prove this, so you will need things like:
- joint lease/rental agreement
- testimonial from landlord (this could be your aunt) that you are living together, and from what date you started to live together
- testimonials from friends/coworkers that you are a genuine couple living together
- mail sent to both of you, with the same address on it
- if each of your employers has a record of your address that shows it is the same
- shared/joint credit cards or bank account
- life insurance with each other listed as primary beneficiary
- the Canadian can change status with Canada Revenue Agency to common-law

Ok this is my situation, my aunt sponsor me, im unware that same sex relationship is legal here ( yeah right that make me feel so stupid ) if i know i will just declare her and be with me when i left in the philippnes, we did not live together in the the philippines, now im living with my aunt here in canada, i dont have my own place for now, so my question is if im going to sponsor her, is it a problem that i dont have my own place? We have photos, and im sending money to her, and now im planning to open a joint account in the philippines, by getting a spa here, my other option is to invite her here in canada and we will get married.. To be honest im really frustrated , that is my situation now... Tia....

Take the time to thoroughly read the responses you got. You didn't answer Rob's question about whether or not you lived together for 12 months. Your best chance is with common-law sponsorship.

You will not be able to get a visitor's visa for her because you are in a relationship with her. You need to apply for PR. Another option is to get married in a third country where same-sex marriage is legal, but there will also be visa issues getting there. Some countries may be easier though.

It will not be a problem that you do not have your own place currently. For spousal sponsorship, there are no requirements for the sponsor's financial situation.

If you aren't married, and you have never lived together for 12 continuous months, then you are not in a relationship that CIC recognizes for sponsorship. So you would not have been able to sponsor her anyways under your Aunt.

I assume you are a citizen of Philippines, and a PR of Canada, is that correct?

If this is the case then there is no legal barrier for you to live with her 12-continuous months in the Phillippines and become common-law. For this reason you will not qualify for conjugal sponsorship (unless there is some law about same-sex couples living together, or if there is fear of persecution or something for this reason).

The easiest way for you will be to get her a TRV to come visit Canada, and get married here. Then you can apply inland and she can stay in Canada during entire processing time.

If she can't get a TRV i think the only way is for you to wait 12 months and live together in Philippines, then apply outland through Manila. Since you are a PR you will need to return to Canada after 12 months to do the application, so unfortunately you could be apart for a very long time. Hopefully she can get a TRV to Canada.
