WE ARE CITIZEN OF INDIA AND IN INDIA THERE IS NO LEGAL REGISTRATION OF OUR MARRIAGE (SAME SEX MARRIAGE) THATS WHY I THINK WE ARE CONSIDER IN CONJUGAL PARTNER. If you have resided together for more than twelve months, you are common law for Canadian immigration purposes.

Conjugal is much more limited - are one of you a Canadian citizen or PR and planning to sponsor the other?

No my partner is currently in Canada on student visa (study permit) and we are planning to summon me under the conjugal partnership visa. I have the question here. As many heterosexual couples summon their partner on the basis of dependent spousal open work permit while being of study or work permit. Can we do that too? Can my partner file me for dependent spousal open work permit (while our case falls under conjugal partnership)

Heterosexual couples can only do so on the basis of being married or being common law (having resided together more than 12 months at some point).

I do not believe there is a conjugal partnership visa of the type you are thinking (the one that does exist is for citizens or permanent residents to sponsor their spouses). If I"m correct, you would have to travel to a jurisdiction where you could marry (eg apply for Cdn visa as a start).

BUT: you really should post in the student visa forum. You have posted in the family sponsorship forum, where the issue is citizens or PRs sponsoring their family members. Since your partner is a student, this forum is not the right one.

Conjugal will only be possible after your partner has PR status and is able to submit a conjugal sponsorship application.

Spousal open work permits are only possible for individuals who are married or common law. It is not possible for conjugal couples.
