Same-sex common law in progress: Can I visit my dad?

Hi everyone!

I am a Canadian citizen I was doing long distance with my girlfirend for a year and a half because my mom had cancer so I stayed in Canada. We have been living together in Cambodia so we can be together since July 2017 and she just got denied a visitor visa to Canada a month ago.

I know common law would be a stronger case than us filing a conjugal application. But while we're in progress with common law can I visit my dad for 2-3 weeks before our one year mark? We have an apartment together and we will just keep it while I go visit my dad. My mom passed away earlier this year and my dad is alone.

Right now we can't get married because it is not legalized in Cambodia. From what I know about the same sex marriage legis

You can go travelling, as long as your formal address is still at the location. Are both your names listed on the apartment rental?

The fact that marriage is not legal in Cambodia is a perfect excuse to explain why you are not married. The form asks something along the lines: If you are conjugal, why aren't you married?

Except they would need to explain why they can't marry OR live together to become common law, and they are currently living together.

2-3 week trip is fine and should not impact the 1 year continuous cohabitation for common law. If you go above three weeks - it could be a problem. Agreed that a common law application will be an easier path than conjugal. If possible - go that route.

Thanks so much for your reply that is helpful. I am also looking into the possibility of getting married in Argentina as they allow foreigners to marry legally in same sex marriages. Do you know anyone with experience with this too? There is a company that even provides services to accommodate couples on short stays

Thanks! Yes both our names are on the lease and my landlord is also my partners' childhood friend. He will happily write another letter confirming we live together and also he gives me a monthly invoice for our bill with our names on the invoice even though I pay for it.

Yes we will try to wait it out until July or if there is a possibility we may even go to Argentina to get married. I am seeing how hard it is for a Cambodian to get a visitor visa to Argentina. It's easy for Canadians.
