Same boss but different companies??

Hi,

I'm currently living in Canada and I will be applying soon under CEC class, now I'm holding post graduate work permit and it's gonna be expired on March. Here is the thing, my boss recently started a new company and he wants to transfer me to his new company but offer me the same title and position, and he will renew my close work permit under the new company which is the LMIA exemption one. And I've worked at his old company for 9 months till now. Would it be affected of me claiming the 50 points?

And here's what cic said about it, but I'm still confused about the employer part, so basically how does the employer mean? the boss or the company itself??
    • are currently working for an employer specified on the work permit
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

Its not a problem but you beter to write an explanation letter like saying 9 months in one company and rest on other company and attach all the T4 and NOC and pay stubs.

The company is the employer.
If your boss is going to help you apply for a new work permit, why would it be eligible for "LMIA-exempt?"
If your boss is able to get a positive LMIA for you, then you would automatically get the 50 points.
