RQ-my life changed.....

Just want help.
I moved to Vancouver with my husband on 2006, stayed till 2009 ( 3 years) during our stay at Vancouver we worked hard and did not went outside of Canada,
We worked as volunteer as well, we learned to be as Canadian we should be legality ,me and my husband applied for citizenship but get failed each 3 times, we had interview with judge and again failed, they send a letter that we don not have knowledge about the Canada ( since my husband get his Master degree from UBC , CANADA ) during my interview I saw my test paper marked 14 from 20, both my husband and I get filled from the test , I GET DEPRESS and could not care myself , I even could not sleep I used to have medicine for my depress, I stayed two more years and my husband went back to our country ON 2009 ( after he get failed with judge) for his family problem, during his stay away , he get 2 times heard attack (I knew his heard attack was for why we get failed from the test and judge , but he did not told me the reason of his heard attack), he need me to stay with him for his illness, I moved from Canada to care of him, and I got citizenship test letter again, but could not be able to go for the test , I received 3 times notice to be appear for citizenship test,I could not be able to leave my husband to go back to Canada for citizenship test for two reason :
1- my husband doctor told not to leave him till his recovery.
2-we both was working to receive our citizenship , and I promised him we will get it together.
During ,I received RQ,I filled RQ and send it back to Canada, my husband doctor now allows me to go back to Canada after his recovery , I get depress again, During stay from 2006 till now I could not be able to receive my citizenship .I was so hard working during our stay at Canada, we was very loyal and very helpful to Canada, ,WHY I GET RQ ?, what dose it mean? ,Dose my application for citizenship will make a problem for future?, for your information I have to re apply for citizenship in next 3 years , you can see from 2006 till 2016 not received my citizenship ,it was not fair that the judge failed us on 2009 and make this big problem to our life

Please help.

1. If your husband left Canada in 2009 and hasn't returned, then he has not met the requirements for his PR residency and it quite possible that he will lose is PR status.
2. As to your PR status, it depends when you left Canada. You still have to maintain your PR status by remaining in Canada for 2 years in every 5 year period.
3. You probably got the RQ because you weren't in Canada or were unable to proof that you resided in Canada.
4. By missing 3 test notice is another way to get an RQ.

Just to let you know ,
1-my husband left Canada on 2009 and I let on 2011, both me and my husband PR will be expire on 2016,
still we can not re enter Canada under our PR card?
2-Dose RQ take a long time process? dose it make a problem for our next apply for citizenship on 2016?

Yes, you can re-enter Canada on your PR card.

If you left in 2011, you have been outside Canada for 2 years now. In order to meet the residency obligation, you must have 730 days (2 years) in Canada in the past 5 years. If you still meet the residency obligation, if the immigration officer asks, just tell the truth that you lived in Canada until 2011 and then left to spend time with your husband.

Your husband however does not meet the residency obligation if he left in 2009. He has been outside Canada for 4 years. In the past 5 years, he only has 1 year in Canada. When he enters Canada with his valid PR card, it is possible that immigration will ask him if he meets the residency requirements. If he said he had 2 heart attacks and therefore could not travel, it is possible they will just let him in but they can also report him for not meeting the requirements. If they do that, he can still enter Canada but he would have to appeal to keep his PR. If they do not report him, he can enter Canada but he should count himself lucky and if he wants to keep his PR, he should stay in Canada for 2 years straight and during that time should not apply to renew his PR card or apply for anything else from immigration. After 2 years, he will meet the requirements again and can apply to renew his PR card.

When did you receive the RQ? You have 45 business days to respond. If it is more than that, you can forget about it - your citizenship application would have been abandoned.

The more pressing matter at hand is to save your husband's PR status. Both of you should make preparations to enter Canada soon. If he is let in without being reported, consider him lucky. Otherwise, he is on the verge of losing his PR status.

Fortunately, you are still a PR - this could be a factor at the inadmissibility hearing if it comes to that. Technically, you should be able to sponsor your husband back into Canada if the worst were to happen.

The lawyers are giving you bad advice. Your husband does not meet the residency requirements. If the immigration officer suspects that when he enters Canada, they can report him for not meeting the requirements. That is the first step to revoke his PR status. If that happens, he would be allowed to enter Canada but would have to appeal for his PR. If they do not believe he had a good reason for being outside Canada for so long, they can revoke his PR. However, as you still meet the requirements, you would be able to sponsor him for PR again.

It is possible that he can enter Canada without being reported but nobody can guarantee you that.

me and my husband are very legal person, and not lawbreaker ,if we enter to Canada I will explain to officer at airport honestly about me and my husband station case on our arrival ( even they ask or not ask ) , we want to live peacefully and we obey what the law says.

I have a feeling that it might be better if you go with your husband. The border official might be a little lenient towards him seeing that your status is not in question. No guarantees though.

Hi sky2f, This is a suggestion in regards to your citizenship application attempts. There are quite a few free English lesson courses available for new immigrants to take to get familiarized with the language the north American way. LINC is one of them.

These courses help you get a better understanding of the language and the teacher may even help you guys with the Canadian history and setup in preparing you for a citizenship test. You know many of us do have problems with English and if Canadian government requires us to know the country's history and reasonable fluency on either of its 2 national languages, so be it, we got to oblige. I don't know in which province you stay/would like stay in the future. May be these courses can help you by leaps and bounds. Just a suggestion.
