Hello! I had a question about my PR renewal. It would be great if someone can help me with this situation. I am a canadian PR with initial PR status in 2007. I renewed my PR card as I had fulfilled my residency obligation. MY current PR is valid till february 2018. I am a doctor and started residency in the US in 2012 and am currently doing a fellowship which will finish in june 2019. For both my residency and fellowship, US needed an assurance from health Canada known as a statement of need. The statement of need (issued by health Canada) states that there is currently a need in canada of physicians of my specialty and that I have filed a written assurance with government of canada that I will return after my fellowship and practice in Canada in my specialty. Now my PR card is expirinf in february 2018, should I apply for renewal based on H and C grounds or should I wait and finish my fellowship and get a PRTD/drive to canada and then apply. I am confused about what to do in this situation. Any suggestions will be appreciated
 
Hi There,

Since you are in the US, I would just recommend you drive, you DO NOT need a PRTD if you are driving.

CIC clearly states you only need a PRTD if you travel with a commercial carrier.

Just go with your passport and your confirmation of permanent residency or even your expired PR card should suffice. Since its only been a year since it expired the officer may or may not report you.

If you do get reported then you would need to go to CIC and explain yourself. If they don't accept your H&C grounds they will trigger a process to revoke it.

If you do get reported, you can show them the statement of need and try to argue that you only left Canada to gain essential skills which you always intended to use to come back to help Canadians. (H&C) May or may not work.

NOTE: Once in Canada, you will need to wait 2 years before you can apply for a PR card, or else you run the risk of being reported. You also can't leave the country as you may be reported on re-entry. If you want to avoid this, once in Canada apply for a renewal of PR card on H&C grounds. This would be better for you than applying for a PRTD in the US and trying your luck.
