Hello Friends,

I have a query regarding PR for my parents....My parents had Permanent residency app 12 years back....But they never met the PR obligations and hence the PR cards have been expired....
Now I want them to come here once again...I hear somewhere that the PR is never lost automatically.....Should I apply for the new application or is there a way to revive the old residency once again....

An early response would be highly appreciated....as, if I have to apply for a new PR I have to act quickly.....

They can try to save their PR status but there's no guarantee it will work.

They would need to re-enter Canada without being reported for failing to meet the residency obligation. If they are able to re-enter without being reported, then will need to remain in Canada without leaving for two years straight before applying to renew their PR cards. During this time, they may find it difficult to obtain a SIN (if they don't have one already), obtain health cards, etc.

If they are reported on entering Canada for failing to meet the residency obligation, they will have to appear at a hearing to argue why they should be allowed to keep their status. They should expect to lose this hearing, have their PR card officially revoked, and be forced to leave Canada.

As for actually coming to Canada and entering, if they hold visa exempt passports - they can fly directly to Canada. If not, they will have to obtain a US visa, fly to the US and then enter Canada via a land border.
 
Many thanks for your reply my dear friend..We applied for their visitor visa long time back and it was granted...They have visited Canada multiple times after that....I am not sure if they were ever reported at the airport as no body asked them anything...

Regarding the hearing that you mentioned...is it smething in the court or should we reach out to CIC for this?

If they were granted visitor visas then they no longer have PR status and have officially lost any claim to PR status. It is impossible to be approved for a visitor visa if you are still a PR.

Based on this new information you have provided, if they want to become PRs again they will have to apply again from scratch. It is impossible to save their old PR status - it is gone.

Note that you need three years of income from Canadian sources that meets the low income cut off in order to sponsor your parents (if you plan to sponsor them rather than having them apply for PR themselves through a program such as skilled worker). Additionally, you need to provide three years of Canadian tax returns to prove that you meet the low income cut off. Parent applications will start being accepted again by CIC in January 2016 and there is an application cap, which will most likely be reached in a day or two. So if you don't meet the income and income evidence requirements now, you'll have to wait at least another year before you can apply.

I meet the low income cut off for 2013, 2014 and 2015... but for current year 2015 I can prove it through my canadian Pay stubs plus a letter from the company confirming my income. Please advise if I should drop application to sponser my parents in January 2016 once they opened the application for parent sponsership.

No - you can't. You need to provide your CRA Notice of Assessment for 2015. Pay stubs and a letter won't be accepted. You have to wait another year before you can apply.
