RETURNING TO CANADA WITH PR CARD EXPIRED

Hi Leon,
My husband's PR card expires on July 25, 2016 and he is currently in the Middle East. He has not met the PR obligation. Now he plans to return to Canada after the PR card get expired.

What does he need to do to be able to re-enter Canada?
He plans only to visit us and return to Middle East.
Can I still re-apply for a new PR for him ?
How much time it takes for spouse to sponsor (so he can prepare himself to stay with us for good when he gets approved)

you have to apply for a new PR card otherwise no airline will allow him to enter in Canada on expired PR card

In this case, he can not apply for a new PR card as he doesn't meet the RO (residency obligation).

He could either visit before his PR card expires or if he has a visa exempt passport, he can visit before September when eTA becomes mandatory or if he doesn't have a visa exempt passport but he has a US visa or can get one, he can fly to the US and enter by land.

He could be reported on entry for not meeting the RO. If that happens, he could appeal but if he doesn't have any H&C (humane & compassionate) grounds for not meeting the RO, an appeal is pointless because he would lose it.

He can be sponsored for PR by a spouse who is either a Canadian or who is a PR and is residing in Canada and meets the RO herself. He can however not be sponsored while he is still a PR. He needs to lose his current PR first.

He could either apply for a PR travel document that would be denied and he would lose his PR as a result or he could simply renounce his PR based on that he did not meet the RO. Then he can be sponsored again.

Once he is no longer a PR, he can apply for a visit visa to Canada but of course it is not guaranteed that he will get it.
