Returned app (Form 5669) and Non-Accompanying Declaration (Form 5604)

Evening y'all.

I'm a Canadian citizen sponsoring my American husband and 11 y/o stepchild. Our app was received on Nov 5, 2018 and I've been patiently (okay, obsessively) awaiting my AOR any day now.

Unfortunately, I only just realized that I goofed up on form 5669 (Schedule A Background Declaration), bc although we typed our signatures in the box, we didn't physically sign them. I'll save my thoughts on how stupid it is that the form explicitly states a digital signature is sufficient while somehow still requiring a real signature, and just cut to my question: IF/WHEN MY APPLICATION IS RETURNED, WILL MY PROCESSING TIME START FROM DAY 0, OR WILL THEY RESUME PROCESSING WHEN I RE-SUBMIT THE SIGNED VERSION OF FORM 5669??

My second question is in regards to my stepchild. My husband has sole custody, including the right to relocate anywhere. Despite this, we've made several attempts to have his ex sign off on the Non-Accompanying Parent form (Form 5604), and she has refused. Her reasoning is flimsy, and mostly due to her wanting to be difficult for the sake of it, but I'm wondering: HAS ANYONE ELSE WITH SOLE CUSTODY DEALT WITH A DIFFICULT NON-ACCOMPANYING PARENT REFUSING TO SIGN THE DECLARATION (FORM 5604)? IF SO, HOW DID YOU WORK AROUND IT/WERE YOU SUCCESSFUL?

If the application package is returned, processing time will start from day 0 from the day you resubmit the application. It will be like you're sending the application for the first time.

If your husband has sole legal custody, then I don't think you should have any issues if she refuses to sign. He has the right to relocate the child. If you have email evidence that she has refused to sign the form, I would included that with your application package.

In the future, recommend you don't type in all caps - makes it much harder to read.

Thank you for responding, scylla! I actually just received an AOR email today, so I'm hoping that even if I have to re-send the form, my clock won't reset. The custody issue is a huge relief as well!

Re: the all caps, I actually thought bolding it and typing that section in caps would make it easier, since I'm so long-winded. LOL, noted for next time.
