Return of the application package

Hi,

I have got married to an Indian citizen who is a PR holder in Canada and has been living there for 5 years now. We filed for our application for immigration under the Sponsorship of Family Class and our entire application packet has been returned to my sponsor's address stating that my application is incomplete as the Option C printout is missing for further processing.

We will be resending the packet along with the Option C. I would like to know, that do they resend the entire docket back or they generally ask only to submit the pending document?

Does this happen with everyone?

Also, what all do we ensure before resending the entire docket of application back to CIC.

Would appreciate a quick response as it is urgent.

Unfortunately, they do state that they will return your app if it isn't complete. Did your sponsor include a letter with the application to explain why there was no Option C? Generally, as long as you acknowledge and explain why a certain part of the app isn't there and when it will be sent, CIC accepts that. If there is no explanation for the missing part, then CIC will think that you either didn't see that part or intentionally left it out. As for whether they usually return the whole app or just request the missing bit, I think that decision does come down to the individual officer processing the app. There have been others who have had their whole app returned because of one missing form.

CIC only stated that the Option C was missing, so you should be fine now that you are adding that. To make yourself feel a bit more confident about the app, go through all of the checklists again and make sure that EVERYTHING is there. And then do that one more time :)

But there was another similar case and for them they just asked for the missing document to be shared and not the entire docket was returned to them.

Anyhow, I am sure we cannot do much about it.

Any idea how long does it take them to start checking after they receive our docket again. is it considered as an old case or a fresh case altogether?

Can I in the meanwhile apply for a visitor to go to Canada stating that my spouse visa is under processing, considering it has been 4 months I have been married and the application has not moved an inch?

Is there anyway i can be with my husband considering it is getting difficult to stay alone and is mentally disturbing?

Yes, some people get the app completely returned and others just have the missing document requested; there is no standard, that's why I think that it is the visa officer's decision. And no, there isn't anything that you can really do about it.

Unfortunately, from what I've read of other such cases, your app will go to the bottom of the pile again.

You can apply for a TRV whilst you have a PR app in process but I'm sorry to say that there is little chance of getting it. It is very rare that TRVs are granted in your situation because one of the conditions of a TRV is to be able to prove stronger ties to your home country than to Canada. CIC will almost always consider a spouse in Canada a stronger tie than pretty much anything in the home country. You can try, there have been a few very rare cases that have been approved but don't put too much hope into it.

Sorry I couldn't give you better news.

you should learn to live with this waiting game with the immigration canada. i'm waiting for almost 3 1/2 years with 2 children here. & my small son is a canadian citizen too. but they dont care that you are mentally disturbing or you got mad. & i had to wait 1 1/2 yrs till they got my application to in process as they have missed my application set.
so plzzzz be calm 1st & think that you are so lucky by knowing this forum in the early stage. now you can get 1000s opinions from 1000s people who is in this forum without doing even a single mistake. so, plzzzz dont panic to put the application set b4 you confirm that it is fully completed. bcoz, we did not know anything when we were applying my application & done so many mistakes & now i was refused & waiting for an answer from IAD.
so, if you apply with a perfect application kit you will never been refused & will get through very quickly.
* so plzzzz go through your 2 document check lists & check whether all the documents are ready & submitted
* plzzzz check whether you have answered ""yes" to "No' questions & have answered "No' to "yes" questions in IMM1344E- Application to sponsor sponsorship agreement & undertaking?
* Option C is very much important for a sponsorship & without that they never accept your application for process it. how come they know that you are eligible to sponsor your spouse?
* check whether you have filled all the application correctly & properly answered. bcoz they are expecting the answer what the way they expected. so, you have to go with the guides to fill the application. bcoz, they have mentioned the answers the way they needed.
so, plzzzz check all what i mentioned above.
dont worry you will get through cleverly. i mentioned these not to make u'll scared, but for your own good.....
so feel free to ask anything & will help you the way i can.....

This wait is just getting endless and yes I totally agree they do not care if a person is going mad or not.

I will ensure all the things mentioned by you.

I shall keep coming back in case any next problem arises. Seems like it has become the biggest ordeal of my life.
