Hey Guys

This may be a little tricky but if anyone has any idea about this, help would be appreciated.

I used to have a work permit and it expired. And then i applied for restoration of status as visitor, still havent got it though.

Meanwhile i my employer applied for LMIA and got it approved. Could any one tell me if i can apply for the work permit now within canada or do i need to go out apply and then come back?

No. I think you should apply for your work permit extension. There should be no issue since you applied for restoration which they will see.
 
But my current status is Visitor so i cannot call it an extension i guess right?
 
My husband's status had been changed to visitor as well after the work permit expired, once he got the lmia he flagpoled and got a new work permit.

Hey. Thanks for the reply, which country are you from? Just wondering if this applies to people from all the countries

Your husband is visa exempt. So this unfortunately doesn't apply to the OP.

Exactly!! So i am wondering what does the people from non visa exempt countries gotta do
 
I think, you have to call the CIC and ask them. Take a risk and flagpole it.

I'm in the same situation but my LMIA isn't approved yet. How long it took you to get the visitor status?

If you are still in restoration period ( 90 days from date of expiry of your work permit ) , then you can withdraw your visitor application and apply for work permit extension surely . But , you have to clear everything in SOP that how your LMIA got approved after your visitor application .

If your restoration period is over , then there is nothing other than waiting for a decision on visitor application .

Hi there we have the same situation, my work permit expired too and im planning to apply as a visitor since i dont have LMIA anymore .. what form did you used is it IMM 5708???
 
Got my visitor and LMIA approved in the last two weeks, so applying WP now. Apparently it seems i have to apply at the NY office. I mean, i have tos end the docs to new york

I'm in the same situation..How did you apply at NY office?? as far as i know we can only apply at Vegreville for work permit extension..
i was thinking to do flagpole ....is that safe to do so?? as i'm not from visa exempt country..

You can only flagpole if you're from a visa exempt country.

After doing lots of research finally i come to know that, in restoration period if you don't have any LMIA then you can apply for Visitor visa application, once LMIA approve then you can only apply work permit at POE or outside Canada as visitors can't apply at CPP-V.

you can show it CBSA officer, a letter that you already have an application for visitor visa and still under processing..

I would try flagpole it. It's gonna take 100 plus days to get the permit.
