Hello Peeps,

Story is :

I applied for a work permit extension as a dependent. My wife's work permit was approved but my work permit was refused for some reason. So my open work permit was expired on 8 July 2021. I have got a decision on 20th August and I have applied for restoration and work permit of my status on 28th August. So I was wondering If I am allowed to continue working as a previous open work permit conditions or Should I Stop working. please Suggest to me, what should I do. when I applied previously application, they sent me a letter that I can have the same conditions until 20th november. So, please let me know can I continue working. thank you

You are no longer entitled to work. The letter you received regarding working under the same conditions until November 20th would have indicated that you can work until this date OR until a decision has been made in your application. Since a negative decision was made, you are no longer entitled to work effective Aug 20th.

There is a public policy in place which allows certain qualifying individuals to work during restoration. You have to meet the criteria and also request special approval from IRCC to work and be approved work by IRCC while you wait for the restoration application to be process. Details about this public policy are below.

If you meet the terms of the public policy, submit the request to IRCC to request authorization to work. You won't be able to work until you receive approval from IRCC.

Based on your original post, it looks like you were on an open work permit and are trying to restore your status to an open work permit. If that's the case, then I don't believe you qualify for the public policy I mentioned above since this is only open to closed work permit holder.

If you don't qualify under the public policy, this means you'll need to wait for restoration to be approved and for your new open work permit to be issued before you will be legally eligible to start working in Canada again.

I forgot to mention you that , I have applied for cec is as well . I have Aor just waiting for copr . I am not sure if that will be okay for working ?

No, submitting a CEC application does not entitle you to work.

Did you apply for a Bridging Open Work Permit (BOWP) after getting AOR for the CEC application and before your last work permit expired on July 8th?

NO I applied for open work permit on 7th july and I got a letter on 8th july for working rights . I dont know what to do now !

Unfortunately you are no longer entitled to work effective the date you received the refusal.

You'll need to wait until your status and work permit is restored before you'll be able to start working again.
